Title: To authorize the Department of Technology to donate miscellaneous computer equipment to Mt. Vernon District Improvement Association, to waive Section 329.30 of the Columbus City Codes, 1959, which governs the sale of city-owned personal property; and to declare an emergency.
Explanation
 
This legislation authorizes the Director of the Department of Technology to donate accumulated surplus equipment for which it no longer has a use.  Although this equipment has been offered to all City departments, it has been determined that this equipment is not functionally useful for any City purpose and is of de minimis value.  As a result, the Department of Technology is seeking permission to donate this equipment to Mt. Vernon District Improvement Association, Inc., a 501(c)(3) designated charitable, located at 340 North 20th Street in the City of Columbus.  Because this equipment is of de minimus value on the open market, the Department of Technology is requesting that the provisions of Chapter 329 of the City Code pertaining to sale of city-owned personal property to be waived.
 
Fiscal Impact:  None.
 
Emergency Designation:  This ordinance is being submitted as an emergency measure so that Mt. Vernon District Improvement Association  will have access to this equipment at the earliest possible date.
 
 
 
Title

Body
 
 
WHEREAS,      the Department of Technology is in possession of miscellaneous surplus computer equipment that is no longer being used by the Department; and
 
WHEREAS,      the Department of Technology has offered this equipment to all City departments but it has been determined that this equipment is no longer functionally useful for any City purpose; and
 
WHEREAS,      this equipment is of de minimis value; and
 
WHEREAS,        the Director of the Department of Technology would like to donate said equipment to Mt. Vernon District Improvement Association, Inc., a 501(c)(3) designated charitable organization that has expressed interest and a need for computer equipment; and  
 
WHEREAS,         the recipient agency,  Mt. Vernon District Improvement Association, Inc. understands that the City of Columbus will not maintain or support these computers once donated and they agree that the computers will be accepted "as is".
 
WHEREAS,      for the reasons articulated above, it is in the best interest of the City Of Columbus to dispose of this equipment in this manner and waive Section 329.30 of the Columbus City Codes, 1959, which governs the sale of city-owned property; and
 
WHEREAS,      an emergency exist in the usual daily operation of the Department of Technology's Office in that it is immediately necessary to donate this computer equipment to Mt. Vernon District Improvement Association and to waive Section 329.30 of the Columbus City Codes, 1959, so that users of the center have access to this equipment at the earliest possible date; thereby preserving the health, peace, property, safety, and welfare of the City of Columbus; Now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.      That the Director of the Department of Technology is authorized and directed to donate miscellaneous surplus computer equipment to Mt. Vernon District Improvement Association, a 501(c)(3) designated charitable organization, Federal ID # 31-1102784, located at 340 North 20th Street in the City Of Columbus.
 
SECTION 2.      That for good cause shown, Section 329.30 of the Columbus City Codes, 1959, governing the sale of city-owned property, is hereby waived.
      
SECTION 3.      That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
