Explanation
The City owns fee title to the real property located on the southwest corner of Duvall Road and Walnut Creek Pike, Ashville, Ohio 43103, Pickaway County Tax Parcel Numbers F1600010002000, F1600010002001, and F1600010010200. The property was purchased by the Department of Public Utilities in 1992 for use in the South Wellfield Expansion Project as authorized by Ordinance #1963-77, passed by Columbus City Council in October, 1977 and Ordinance #1775-92, passed by Columbus City Council in July, 1992. Studies determined that the water table on the property is not suitable for use in that project, and recent review of the property did not identify any other use for City operations. The site is approximately 116.92 acres plus or minus and is surplus City property.
Ordinance No. 0402-2011, passed by Columbus City Council on 03/17/2011 granted authority to the Director of the Department of Finance and Management to determine the current marketability of this property and to entertain discussions and negotiations with interested parties with respect to the sale of this property. The ordinance provided that any agreement for the sale of the property would require approval by subsequent Council ordinance.
The Duvall Road property has been exposed to the market through public notices in the Columbus City Bulletin since 03/23/2010, by a commercial real estate listing since 04/11/2011, and by a "For Sale" sign on the property. The City has received multiple purchase offers within the estimated market value range for this property and with terms acceptable to the City. It is, therefore, deemed to be in the City's best interest to enter into a formal contract with the prospective purchaser who presented the highest and best offer for the sale of the 116.92+/- acres on Duvall Road, Ashville, Ohio 43103.
This ordinance authorizes approval for the sale of that City owned real property and authorizes the Director of the Department of Finance and Management to execute those documents necessary to enter into a contract with Pewamo, Ltd., a Domestic Limited Liability Company, for the sale of the property for a price of $355,000 and to execute a quitclaim deed and any ancillary documents necessary to grant fee simple title to said property.
Fiscal Impact: Proceeds from this transaction shall be deposited in Fund 60-09-608, Project 690359-100001, OCA Code 060533.
Emergency Justification: Emergency action is requested to enable the City to immediately enter into contract and schedule a closing date so the property can be prepared for the 2011 planting season.

To authorize the Director of Finance and Management to execute those documents necessary to enter into contract with Pewamo Ltd., a Domestic Limited Liability Company, for the sale of City-owned surplus property located on Duvall Road, Ashville, Ohio 43103 and to execute those documents necessary to grant fee simple title; and to declare an emergency.

WHEREAS, that real property owned by the City of Columbus and located on Duvall Road, Ashville, Ohio 43103 has been deemed to be surplus City property; and
WHEREAS, pursuant to Ordinance No. 0402-2011, the Department of Finance and Management received authority to determine the current marketability of this property and to entertain discussion from and enter into negotiations with interested parties with respect to the sale of this property; and
WHEREAS, the property was offered for sale through public notice, a commercial real estate listing service, and property sign; and
WHEREAS, the City has received a purchase offer for said property from Pewamo, Ltd., a Domestic Limited Liability Company, in the amount of $355,000 and with other terms acceptable to the City; and
WHEREAS, the Director of Finance and Management deems that it is in the best interest of the City to enter into a sale contract with Pewamo, Ltd., a Domestic Limited Liability Company, for consideration in the amount of $355,000; and
WHEREAS, an emergency exists in the usual daily operation of the City, in that it is necessary to immediately authorize the Director of the Department of Finance and Management to execute those documents necessary to enter into a contract with Pewamo, Ltd. for the sale of property located on Duvall Road, and to execute a quitclaim deed and any ancillary documents necessary to grant fee simple title to the same real property thereby preserving the public health, peace, property, safety and welfare; NOW, THEREFORE:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of the Department of Finance and Management be and is hereby authorized to execute those documents on behalf of the City of Columbus, as approved by the Department of Law, Division of Real Estate, necessary to enter into a contract with Pewamo, Ltd. for the sale of City-owned property located on Duvall Road, Ashville, Ohio 43103, and to execute a quitclaim deed and any ancillary documents necessary to grant fee simple title to said property.
SECTION 2. That the sale proceeds to be received by the City shall be deposited in Fund 60-09-608, Project 690359-100001, OCA Code 060533.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
