Explanation
1.  BACKGROUND
Pizzuti Land LLC, an Ohio Limited Liability Company, by Scott B. West, Senior Vice President and Pizzuti Rickenbacker West I LLC, an Ohio Limited Liability Company, by Scott B. West, Senior Vice President, has submitted the plat titled Beggrow Street Dedication Phase I to the City Engineer's Office for review and approval.  This plat has been reviewed and approved by the City Engineer.  The following legislation allows the City to accept said plat for property located north of London-Groveport Road and west of Shook Road.  The width of the Right-of-Way to be dedicated for Beggrow Street is 60 feet and the length is 1,194.50 feet.
 
Sidewalk  construction within these rights-of-way shall be in accordance with the Public Service Department's Rules and Regulations requiring the construction of sidewalks within commercial development areas of the City.  These Rules and Regulations are as authorized by Ordinance 1276-1999.  Sidewalks along this street are to be constructed at the same time as roadway construction and are a part of the plans for constructing this street.
 
2. EMERGENCY DESIGNATION:
Emergency action is requested to allow development of the abutting lands to proceed as currently scheduled.
 
Title
To accept the plat titled Beggrow Street Dedication Phase I from Pizzuti Land LLC, an Ohio Limited Liability Company, and Pizzuti Rickenbacker West I LLC, an Ohio Limited Liability Company, and to declare an emergency.
 
Body
WHEREAS, the plat titled Beggrow Street Dedication Phase I (hereinafter "plat"), has been submitted to the City Engineer's Office for approval and acceptance; and
 
WHEREAS, Pizzuti Land LLC, an Ohio Limited Liability Company, by Scott B. West, Senior Vice President and Pizzuti Rickenbacker West I LLC, an Ohio Limited Liability Company, by Scott B. West, Senior Vice President, owner of the platted land, desires to dedicate to the public use all or such parts of the Street and easements shown on said plat and not heretofore so dedicated; and
 
WHEREAS, after examination, it has been found to be in the best interest of the City to accept said plat; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Division, in that it is immediately necessary to authorize the acceptance of this plat so development of this subdivision can proceed as currently scheduled thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the plat titled Beggrow Street Dedication Phase I on file in the office of the City Engineer, Division of Transportation, be and the same is hereby accepted.
 
Section 2.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
