Council Variance Application: CV24-161

 

APPLICANT:  Cardinal Self Storage LLC; c/o Jill S. Tangeman, Atty.; 52 East Gay Street; Columbus, OH 43215.

 

PROPOSED USE:  Self-storage facility and limited commercial uses.

 

NORTHEAST AREA COMMISSION RECOMMENDATION:  Approval.

 

CITY DEPARTMENTS' RECOMMENDATION: Disapproval. The applicant has received a recommendation of disapproval from Staff and a recommendation of approval from the Development Commission for a concurrent rezoning (Ordinance #1393-2025; Z24-072) to the L-M, Limited Manufacturing District for a self-storage facility and limited commercial uses. The requested Council variance will allow for reduced building setback from 60 to 20 feet along Stelzer Road, and reduced distance separation from 25 to 10 feet from residentially-zoned property. The Northeast Area Plan (2007) recommends standards for future development along Stelzer Road should be consistent with the development standards utilized in the Citygate development. Staff note the proposed site plan includes buildings fronting Stelzer Road, consistent with Plan design guidelines. However, Staff is not supportive due to the inconsistency of the proposed self-storage use with the Plan’s land use recommendation.

To grant a Variance from the provisions of Sections 3363.24, Building lines in an M-manufacturing district, and 3363.27(b)(2), Height and area regulations, of the Columbus City Codes; for the property located at 1941 STELZER RD. (43219), to allow reduced building setback and distance separation for a self-storage facility in the L-M, Limited Manufacturing District (Council Variance #CV24-161).

 

Body

 

WHEREAS, by application #CV24-161, the owner of the property 1941 STELZER RD. (43219), requests a Council variance to allow reduced building setback and distance separation for a self-storage facility in the L-M, Limited Manufacturing District; and

 

WHEREAS, 3363.24, Building lines in an M-manufacturing district, requires a building setback line of 60 feet along Stelzer Road, while the applicant proposes a reduced building setback of 20 feet along the Stelzer Road frontage, as shown on the submitted site plan; and

 

WHEREAS, Section 3363.27(b)(2), Height and Area Regulations, requires a 25 foot distance separation for buildings from residentially-zoned property, while the applicant proposes a reduced setback of 10 feet along the southern property line, as shown on the submitted site plan; and 

 

WHEREAS, the Northeast Area Commission recommends approval of said zoning change;

 

WHEREAS, City Departments recommend disapproval because the proposed self-storage use is inconsistent with the Plan’s land use recommendation for job generating office or industrial uses at this location; and

 

WHEREAS, this ordinance requires separate submission for all applicable permits and a Certificate of Occupancy for the proposed self-storage facility; and

 

WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public streets, or unreasonably diminish or impair established property values within the surrounding area, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and

 

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at 1941 STELZER RD. (43219), in using said property as desired; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That a variance is hereby granted from the provisions of Sections 3363.24, Building lines in an M-manufacturing district; and 3363.27(b)(2), Height and area regulations; of the Columbus City Codes; for the property located at 1941 STELZER RD. (43219), to allow a reduced building setback line from 60 to 20 feet along Stelzer Road; and reduced distance separation from residentially-zoned property from 25 to 10 feet along the southern property line, said property being more particularly described as follows:

 

1941 STELZER RD. (43219), being 4.1± acres located at the southwest corner of Stelzer Road and Citygate Drive, and being more particularly described as follows:

 

Situated in the State of Ohio, County of Franklin, City of Columbus, being located in Quarter Township 3, Township 1, Range 17, United States Military Lands, a 4.103 acre tract of land, said land being part of that original 2.707 acre tract of land conveyed to Magoo Properties LLC in Instrument No. 201203050030014 as Parcel I, part of that original 2.707 acre tract of land conveyed to Magoo Properties LLC in Instrument No. 201203050030014 as Parcel II, part of that original 2.707 acre tract of land conveyed to Magoo Properties LLC in Instrument No. 201203050030014 as Parcel III, part of that original 2.707 acre tract of land conveyed to Magoo Properties LLC in Instrument No. 201203050030015 as Parcel No. 3, part of that original 2.707 acre tract of land conveyed to Magoo Properties LLC in Instrument No. 201203050030015 as Parcel No. 2 - Parcel #22, part of that original 2.707 acre tract of land conveyed to Magoo Properties LLC in Instrument No. 201203050030015 as Parcel No. 1 - Parcel #23, and being more particularly described as follows;

 

Beginning for Reference, at a found Franklin County Monument “FCGS 2265 Reset” on the centerline of Stelzer Road (R/W Varies), said Monument being N 03° 28’ 46” E, 1294.32 feet from Franklin County Monument “FCGS 5509 Reset”;

 

Thence S 03° 28’ 46” W, with the centerline of said Stelzer Road (R/W Varies), 83.79 feet to a mag nail set on the northeast corner of that 0.399 acre tract of land conveyed to Franklin County Commissioners in Instrument No. 200406300152465 as Parcel 21WD, and being on the centerline of said Stelzer Road (R/W Varies);

 

Thence N 86° 21’ 38” W, across the right-of-way of said Stelzer Road (R/W Varies), with the north line of said Parcel 21WD, and with the southerly right-of-way line of Citygate Drive (R/W Varies) as shown in Plat Book 87, Pg. 36, 58.00 feet to a 5/8” iron pin found (“F.C.E.”) on the southerly right-of-way line of said Citygate Drive (R/W Varies), the westerly right-of-way line of said Stelzer Road (R/W Varies), the northeast corner of said Parcel I, the northwest corner of said Parcel 21WD, and being the True Point of Beginning;

SECTION 2.  That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for a self-storage facility, or those uses allowed in the L-M, Limited Manufacturing District, specified by Ordinance #1393-2025; Z24-072.

 

SECTION 3. That this ordinance is further conditioned upon the applicant obtaining all applicable permits and a Certificate of Occupancy for the proposed self-storage facility.

 

SECTION 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
