Explanation
At the beginning of this fiscal year, 2007, and through the technology integration to centralize services and related costs between the Department of Technology and the Department of Public Utilities, the Department of Technology assumed operations and maintenance responsibilities associated with services provided by Perkin Elmer Instruments LLC.  
 
Previously, on March 20, 2006, the Department of Public Utilities entered into agreement with Perkin Elmer Instruments LLC, for maintenance associated with the Surveillance Laboratory equipment.  The equipment is vital to the wastewater treatment process. It is used to test for metals in wastewater at the Jackson Pike and Southerly Wastewater Treatment Plants, and in the Industrial Pre-Treatment Section.  Also, this agreement was authorized by the passage of Ordinance Number 0174-2006, and associated with purchase order EL005994.  
 
In order for the Department of Public Utilities to continue receiving maintenance and related services, this legislation is requesting approval to authorize the Director of the Department of Technology to establish an agreement for one (1) year maintenance, associated with the Perkin Elmer testing equipment located at the Division of Sewerage and Drainage Surveillance Laboratory, with Perkin Elmer Instruments LLC.  The agreement will be in effect for twelve months up to and including March 31, 2008. The maintenance agreement will include all services, labor and parts for the testing equipment.  Perkin Elmer Instruments LLC is the single manufacturer and distributor of the equipment.
 
This ordinance is being submitted in accordance with the provisions of Sole Source procurement of the Columbus City Code Section 329.07 and is being submitted as an emergency measure so that there is not interruptions on the service of lab equipment used for testing.
 
 
FISCAL IMPACT:  This is the first time the Department of Technology has expended any funds for services associated with the maintenance agreement; that include all services, labor and parts for the testing equipment from Perkin Elmer Instruments LLC.  The funds, in the amount of $41,707.92, are available within the information services, Sewer Direct Charges, for this agreement; the amount will provide for twelve months of services up to and including March 31, 2008.  Approval of this ordinance, through the Department of Technology, will bring the contract total to $41,707.92.  
 
EMERGENCY: Emergency legislation is being requested so that there is not any interruption in the service of the equipment at the Surveillance Laboratory.

Body
 
WHEREAS, through the technology integration to centralize services and related costs between the Department of Technology and the Department of Public Utilities, the Department of Technology assumed operations and maintenance responsibilities associated with services provided by Perkin Elmer Instruments LLC; and
 
WHEREAS, the Division of Sewerage and Drainage, Surveillance Laboratory has wastewater testing equipment used to analyze metals in the wastewater at Jackson Pike and Southerly Wastewater Treatment Plants and the Industrial Pre-Treatment Lab that requires to be maintained through periodic maintenance, and
 
WHEREAS, Perkin Elmer is the manufacturer and distributor of said equipment and has submitted a quotation for the one (1) year service agreement and is the sole authorized company to service the equipment, and
 
WHEREAS, the Department of Technology is requesting this agreement to be established in accordance with the provisions of the sole source procurement of the Columbus City Code, Section 329.07, and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Technology, on behalf of the Department of Public Utilities, Division of Sewerage and Drainage in that it is immediately necessary to establish a one (1) service agreement to avoid interruption in the service of the equipment at the Surveillance Laboratory with Perkin Elmer Instruments, LLC., for the immediate preservation of the public health, peace, property and safety; now, therefore
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1. That the Director of the Department of Technology, on behalf of the Department of Public Utilities, be and is hereby authorized to establish an agreement with Perkin Elmer Instruments LLC for the maintenance of Perkin Elmer testing equipment for the Division of Sewerage and Drainage, Surveillance Laboratory.
 
Section 2. That this service agreement is being established in accordance with the sole source provisions of the Columbus City Code, Section 329.07.
 
Section 3. That the expenditure of $41,707.92 or so much thereof as may be needed, be and the same hereby is authorized from the information services, Sewer Direct Charges, Fund No. 514, OCA 514650, Object Level 1: 03, Object Level 03: 3372, Amount: $9,991.92; and Fund No. 514, OCA 514650, Object Level 1: 03, Object Level 03: 3369, Amount: $31,716.00.
 
Section 4.  That for the reasons stated in the preamble hereto, where is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure, which shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
