Explanation
 
1.  BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into an agreement with Pomeroy & Associates, Ltd. in the amount of $204,320.00, for professional engineering services for the Chatterton Road Water Main Improvements Project, Division of Power and Water Contract Number 1105.
 
This project consists of designing 24-inch and 30-inch water mains, connecting lateral lines as needed along Chatterton Road between Noe-Bixby Road and Gender Road.  The purpose of this project is to close a loop for a 24-inch water main, reinforce the transmission route to the Hines storage tank, and reduce discharge pressures at the Parsons Avenue Water Treatment Plant.  The 30-inch water main design will begin at Noe-Bixby Road and end at Reynard Road.  The 24-inch water main will begin at Reynard Road and end at the intersection of Gender Road and Chatterton Road.  This project consists of approximately 11,600 linear feet of water main design.
 
2. BID INFORMATION:  The selection of the firm providing the professional engineering services has been performed in accordance with the procedures set forth in Columbus City Code, Section 329.14, "Awarding professional service contracts through requests for proposals."  The evaluation criteria for any contract awarded under this section shall include:  1. competence to perform the required service, 2. quality/feasibility of the technical proposal, 3. ability to perform competently and expeditiously as indicated by the offeror's workload and the availability of necessary personnel/equipment/facilities, 4. past performance, and 5. an environmentally preferable factor.
 
Statements of Qualifications were received on July 20, 2007.  Three consultants were selected to submit technical proposals for this project.  Pomeroy & Associates, Ltd., Woolpert, Inc., and W.E. Stilson Consulting Group submitted proposals on November 21, 2007.  
 
Upon review of the technical proposals, the bidders were ranked using the criteria mentioned above and Pomeroy & Associates was the firm selected to perform the design services for this project.  Their Contract Compliance Number is 31-1568332 (expires 2/25/08, Majority).  Additional information regarding each bidder, description of work, contract time frame and detailed amounts can be found on the attached Legislation Information Form.
 
3.  FISCAL IMPACT:  There is sufficient funding within the Water Works Enlargement Voted Bonds Fund.

To authorize the Director of Public Utilities to enter into an agreement with Pomeroy & Associates for professional engineering services for the Chatterton Road Water Main Improvements Project; for the Division of Power and Water (Water); and to authorize the expenditure of $204,320.00 within the Water Works Enlargement Voted Bonds Fund.  ($204,320.00)

WHEREAS, three technical proposals for the Chatterton Road Water Main Improvements Project were received on November 21, 2007; and
 
WHEREAS, Pomeroy & Associates was the firm selected to perform the design services for this project based on criteria set forth in Columbus City Codes; and
 
WHEREAS, the purpose of this project is to close a loop for a 24-inch water main, reinforce the transmission route to the Hines storage tank, and reduce discharge pressures at the Parsons Avenue Water Treatment Plant; and
 
WHEREAS, it has become necessary in the usual daily operation of the Division of Power and Water, Department of Public Utilities, to authorize the Director of Public Utilities to enter into an agreement with Pomeroy & Associates for professional engineering services for the Chatterton Road Water Main Improvements Project, for the preservation of the public health, peace, property and safety; now therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Utilities be and hereby is authorized to enter into an agreement for professional engineering services for the Chatterton Road Water Main Improvements Project; with Pomeroy & Associates, Ltd., 599 Scherers Ct., Worthington, OH 43085; in the amount of $204,320.00; in accordance with the terms and conditions of the contract on file in the Office of the Division of Power and Water.
 
SECTION 2.  That said engineering firm shall conduct the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Power and Water.
 
SECTION 3.  That for the purpose of paying the cost of the engineering agreement, the following expenditure, or as much thereof as may be needed is hereby authorized as follows:  Division of Power and Water (Water), Dept./Div. No. 60-09, Water Works Enlargement Voted Bonds Fund, Fund No. 606, Project 690483, OCA Code 690483, Object Level One 06, Object Level Three 6629, Amount $204,320.00.
 
SECTION 4.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
SECTION 5.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
SECTION 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
 
SECTION 7.  That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
