Explanation
 
Background: The City of Columbus (hereinafter "City") desires to purchase certain real property, located in the general vicinity of West Broad Street and North Souder Avenue, from US Roofing Real Estate Holdings, L.L.C., an Ohio Limited Liability Company, (hereinafter "Owner").  The Department of Public Safety proposes to use the property for the City's existing Traffic Control Unit, which presently leases downtown office space.  It as been determined that the property, commonly known as 892 Scott Street, has adequate office and warehouse space to accommodate the 20 member Police Motorcycle Squad and gives the unit easy access to I-670, Route 33 and Route 315.  This legislation authorizes the Director of the Department of Public Safety to execute those documents necessary to purchase the property and to expend $440,000.00 for cost relevant to its acquisition.
 
Fiscal Impact: The Department of Public Safety has determined that the expenditure for this purchase will come from the Public Safety Bond Fund.
 
Emergency Justification:  Emergency action is requested to allow the purchase of the subject real property without delay in order to comply with the terms of the purchase agreement.

Body
 
WHEREAS,      the City of Columbus (hereinafter "City") desires to purchase certain real property, located in the general vicinity of West Broad Street and North Souder Avenue, from US Roofing Real Estate Holdings, L.L.C., an Ohio Limited Liability Company; and
 
WHEREAS,      the City proposes that the aforementioned real property be used for the City's existing Traffic Control Unit; and
 
WHEREAS,      it as been determined that the property, commonly known as 892 Scott Street, has adequate office and warehouse space to accommodate the 20 member Police Motorcycle Squad and gives the unit easy access to I-670, Route 33 and Route 315; and
 
WHEREAS,      this legislation authorizes the Director of the Department of Public Safety to execute those documents necessary to purchase the aforementioned real property and to expend $440,000.00 from the Public Safety Bond Fund for costs relevant to its acquisition; and
 
WHEREAS,      an emergency exists in the usual daily operation of the City of Columbus, in that it is immediately necessary to authorize the Director of the Department of Public Safety to execute those documents necessary for the purchase of said real property for the immediate preservation of the public health, peace, property and safety; now, therefore:
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
      Section 1.      That the Director of the Department of Public Safety be, and hereby is, authorized to execute those documents as approved by the Department of Law, Real Estate Division, necessary for the purchase of the following described real property, from the US Roofing Real Estate Holdings, L.L.C., an Ohio Limited Liability Company for use by the Division of Police.
 
Being Lots Numbers Forty-Eight (48) and Forty-Nine (49) of RODERICK G. SULLIVANT'S SUBDIVISION, of Lot Number 1 as shown on Plat A of the Subdivision of the Estate of William S. Sullivant, deceased, made by John Graham and others, Referees, as said lots are numbered and delineated upon the recorded plat thereof, of record in Plat Book 4, Pages 42 and 43, Recorder's Office, Franklin County, Ohio.
      Being Lot Number Sixty-Two (62) of R. G. SULLIVANT'S AMENDED SUBDIVISION, of Lot Number 1 as shown on Plat A of the Subdivision of the Estate of William S. Sullivant, deceased, made by John Graham and others, Referees, as said lot is numbered and delineated upon the recorded plat thereof, of record in Plat Book 4, Pages 42 and 43, Recorder's Office, Franklin County, Ohio.
      Being Lot Number Sixty-Three (63) of RODERICK G. SULLIVANT'S SUBDIVISION, of Lot Number 1 as shown on Plat A of the Subdivision of the Estate of William S. Sullivant, deceased, made by John Graham and others, Referees, as said lot is numbered and delineated upon the recorded plat thereof, of record in Plat Book 4, Pages 42 and 43, Recorder's Office, Franklin County, Ohio.
      Together with all right, title and interest of Grantor in that certain vacated alley described as follows:
      The east one half of the alley between Lots 55 and 56 and Lots 62 and 63 of R.G. SULLIVANT'S  AMENDED SUBDIVISION, of Lot Number 1 as shown on Plat A of the Subdivision of the farm of William S. Sullivant, deceased, made by John Graham and others, Referees, as the said lots are numbered and delineated upon the recorded plat thereof of record in Plat Book 4, Pages 42 and 43, Recorder's Office, Franklin County, Ohio.  Said alley is east of Jones Avenue and is north of the north line of the first alley north of Scott Street.
      The aforesaid alley was vacated by Ordinance No. 462-84 of the City of Columbus as passed by the Columbus City Council on March 26,1984, and approved by the Acting Mayor of the City of Columbus on March 26, 1984.
 
      Section 2.      That the expenditure of $440,000.00, or so much thereof as may be necessary, from the Public Safety Bond Fund, be and hereby is authorized as follows: Project: Police Facility Renovation-Lease, Project # 330023/ OCA: 644476/ Fund #701/ Object Level Three: 6601/ for the aforesaid purpose is hereby authorized.
 
 
      Section 3.      That for the reasons state in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
