Title: To authorize the Director of the Public Service Department to execute those documents necessary to allow the City to grant an underground encroachment easement into East Broad Street, at 62 East Broad Street, for the Dispatch Printing Company.
Explanation
 
The Public Service Department, Transportation Division, recently received a request from the Dispatch Printing Company ("the Dispatch"), asking that the City grant an underground encroachment easement into the north side of East Broad Street at 62 East Broad Street.  The Dispatch wants to eliminate an existing vault space in the East Broad Street right-of-way and isolate the interior of the building from the exterior.  This easement is necessary to allow construction of the proposed exterior wall.  Per current Transportation Division practice, comments were solicited from interested parties, including City departments and private utilities before it was determined that there would be no adverse impact to the City upon the granting of this easement.  The city attorney's office, Real Estate Division established a value of $500.00 for the granting of this encroachment easement.
 
The City will receive a total of $500.00, to be deposited in Fund 748, Project 537650, as consideration for the granting of the requested encroachment easement.

WHEREAS, the City of Columbus, Public Service Department, Transportation Division, recently received a request from the Dispatch Printing Company ("the Dispatch"), asking that the City grant an underground encroachment easement into the north side of East Broad Street; and
 
WHEREAS, the Dispatch wants to eliminate an existing vault space in the East Broad Street right-of-way and isolate the interior of their building from the exterior; and
 
WHEREAS, this easement is necessary to allow construction of the proposed exterior wall; and
 
WHEREAS, per current Transportation Division practice, comments were solicited from interested parties, including City departments and private utilities before it was determined there would be no adverse impact to the City upon the granting of this easement; and
 
WHEREAS, a value of $500.00 has been established for the granting of the requested underground encroachment easement; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of the Public Service Department be and is hereby authorized to execute those documents necessary to allow the City to grant the following described underground encroachment easement to the Dispatch Printing Company; to-wit:
 
Situated in the State of Ohio, County of Franklin, City of Columbus, being a part of East Broad Street (120 feet wide) of City of Columbus as the same is numbered and delineated upon the recorded plat thereof of record in Deed Book "F", Page 332 (Destroyed by fire), replatted in Plat Book 3, Pages 247 and 248, Recorder's Office, Franklin County, Ohio and being more particularly described as follows:
Beginning at a drill hole found at the southwest corner of The Dispatch Printing Company tract (Instrument Number 199907160181380), Recorder's Office, Franklin County, Ohio in the north line of said east Broad Street and in the south line of Inlot 448 of said City of Columbus plat;
Thence, along part of the north line of said East Broad Street, part of the south line of said Inlot 448 and Inlot 447 of said City of Columbus plat, North 81°36'36" East, 34.43 feet to a point at the southeast corner of said Dispatch Printing Company tract;
Thence, across said East Broad Street and from the east line of said Dispatch Printing Company tract extended southerly, South 08°25'27" East, 0.67 feet to a point;
Thence, continuing across said East Broad Street and parallel 0.67 feet south of the north line of said East Broad Street, South 81°36'36" West, 34.43 feet to a point in the west line of said Dispatch Printing company tract extended southerly;
Thence, continuing across said East Broad Street, North 08°25'27" West, 0.67 feet to the place of beginning containing 0.005 acres (23 square feet)
 
Section 2.  That the $500.00 to be received by the City as consideration for the granting of the requested encroachment easement shall be deposited in Fund 748, Project 537650.
 
Section 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
