Explanation
 
The Franklin County Engineer's Office is completing a project to widen a portion of Kennedy Road from Waggoner Road to a point approximately 1,000 feet east of Waggoner Road in the City of Columbus.  The original plan called for widening the existing pavement but did not include any pavement rehabilitation work.
 
The existing roadway segment is in poor condition.  The Franklin County Engineer has proposed replacing this existing pavement as part of their current widening project at a cost not to exceed $59,229.74.  The work will include full depth removal of the existing pavement, additional excavation, aggregate base and asphalt pavement replacement.  Franklin County has let this project and will oversee the work while the City of Columbus will participate financially.  This ordinance provides for payment of this expense to the Franklin County Engineer.
 
Fiscal Impact:  The Transportation Division budgeted $15.5 million for resurfacing in the 2004 Capital Improvements Budget (CIB.  This ordinance authorizes an expenditure of $59,229.74.  While not specifically budgeted in the 2004 CIB, this reimbursement can be funded due to some resurfacing project bids being lower than anticipated.    
 
Emergency action is requested to allow this project to be completed this construction season and to expedite payment to the Franklin County Engineer.

WHEREAS, the Franklin County Engineer's Office has proposed a pavement rehabilitation of a segment of Kennedy Road from Waggoner Road to a point approximately 1,000 feet east of Waggoner Road; and
 
WHEREAS, Franklin County is the lead agency and has let the contract and will oversee the work, with the City participating financially; and
 
WHEREAS, the County has provided a cost proposal not to exceed $59,229.74; and
 
WHEREAS, funds are available for this expenditure in the 1995, 1999 Voted Streets and Highways Fund, Fund 704; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that payment of this expense to the Franklin County Engineer is immediately necessary so that this project may proceed without delay and be completed this construction season, thereby preserving the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Public Service Director be and hereby is authorized to reimburse the Franklin County Engineering Department for the City of Columbus' share of improvements made to Kennedy Road from Waggoner Road to a point approximately 1,000 feet east of Waggoner Road for which the County is the lead agency.  
 
SECTION 2.  That the expenditure of $59,229.74, or so much thereof as may be necessary, be and hereby is authorized to be expended from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6621, OCA Code 644385 and Project 530282.
 
SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
