Explanation
1.  BACKGROUND
The City of Columbus ("Columbus") is engaged in that project identified as the Arterial Street Rehabilitation - North High Street Flint Road to County Line Project.  Recently Columbus and the State of Ohio, Department of Transportation ("ODOT"), agreed to partner in an expanded roadway improvement project in this area.  
 
The Columbus project will widen High Street by one lane in each direction, add sidewalks, curb ramps and update the traffic signals throughout the project corridor.  The ODOT project will modify the existing cloverleaf interchange at I-270 and US 23 to a Partial Cloverleaf; create a grade-separated, northbound-only roadway which bypasses the signals on US 23 between I-270 and Flint Rd and relocate/extend York Temple Dr. to access West Campus View Boulevard.  
 
The cooperative project will allow construction to be phased in a manner that will be less disruptive to the motoring public and will provide a seamless transition between these projects.  This expanded project will require the City to acquire additional property interests from Flint Road to the Delaware County line.  Per an estimate provided by the City Attorney's office, Real Estate Division, the additional property rights that must still be acquired are currently valued at $800,000.00.
 
2.  FISCAL IMPACT
Monies to pay for these costs are available with the Build America Bonds Fund, number 746.
 
3.  EMERGENCY DESIGNATION
To keep this project on schedule it is essential the City Attorney's Office, Real Estate Division, be authorized to expend those funds necessary to continue their acquisition of the original property rights and begin acquisition of these additional property rights needed for this project immediately.

WHEREAS, it is necessary to amend the 2011 C.I.B. and authorize the transfer of funds within the Build America Bonds Fund, number 746; and
 
WHEREAS, this legislation authorizes the City Attorney's office to expend an additional $800,000.00, or so much thereof as may be necessary to acquire these property rights; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Design and Construction in that it is immediately necessary to authorize the City Attorney's office to continue their acquisition activities for this project and to expend those funds necessary relative to such acquisition to keep this project on schedule thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the City Attorney's Office, Real Estate Division, be and is hereby authorized to continue those activities associated with the acquisition of the property rights needed for the Arterial Street Rehabilitation - North High Street Flint Road to County Line Project.
 
SECTION 2. That the 2011 CIB authorized within ordinance 0266-2011 be amended to provide sufficient authority for this modification as follows:

SECTION 4.  That the City Attorney's Office, Real Estate Division, be and is hereby authorized to expend an additional $800,000.00, or so much thereof as may be necessary from the Build America Bonds Fund as follows: Project 530103-100013; Department/Division 59-12; Minor Object 6601; OCA Code 760313; to pay those costs relative to the acquisition of the rights-of-way needed for the Arterial Street Rehabilitation - North High Street Flint Road to County Line Project.
 
SECTION 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
