Explanation
 
The City of Columbus has been asked to accept various DEEDS, dedicate those parcels of real property for the purpose of road right-of-way, and to name that property as a public road.  Ohio Revised Code Chapter 723.03 requires that property to be used as a public street or alley must be accepted and dedicated as public right-of-way by an ordinance specially passed for such purpose.
 
The following legislation provides for the City to accept various deeds for parcels of real property, dedicate the parcels as road right-of-way and name the parcels as public roadways.
 
Title
 
To accept various DEEDS for real property to be used as road right-of-way and to dedicate and name those properties as Big Run South Road, Montclair Drive, Florian Drive, Fountain Square Drive, Harlem Road, Cassady Avenue and Thompson Road.
 
Body
 
WHEREAS, Ohio Revised Code Chapter 723.03 requires that property to be used as a public street or alley must be accepted and dedicated as public right-of-way by an ordinance specially passed for such purpose; and
 
WHEREAS, the City of Columbus has been asked to accept various DEEDS, dedicate those parcels of real property for the purpose of road right-of-way, and to name that property as a public road; and
 
WHEREAS, by virtue of a GENERAL WARRANTY DEED recorded in the Franklin County, Ohio, Recorder's Office, on September 12, 2003 as Instrument Number 200309120291572, DOMINION HOMES, INC., an Ohio corporation has deeded property to the City of Columbus, to be used for the right-of-way of Big Run South Road; and
 
WHEREAS,      by virtue of a LIMITED WARRANTY DEED recorded in the Franklin County, Ohio, Recorder's Office, on October 23, 2003 as Instrument Number 200310230339952, MORSO HOLDING CO., a Delaware corporation, has deeded property to the City of Columbus, to be used for the right-of-way of Montclair Dirve and Florian Drive; and
 
WHEREAS,      by virtue of a GOVERNER'S DEED recorded in the Franklin County, Ohio, Recorder's Office, on October 23, 2003 as Instrument Number 200310230339953, THE STATE OF OHIO, by BOB TAFT, GOVERNER, has deeded property to the City of Columbus, to be used for the right-of-way of Fountain Square Drive; and
 
WHEREAS,      by virtue of a GENERAL WARRANTY DEED recorded in the Franklin County, Ohio, Recorder's Office, on December 8, 2003 as Instrument Number 200312080388661, M.H. MURPHY DEVELOPMENT COMPANY, an Ohio corporation, has deeded property to the City of Columbus, to be used for the right-of-way of Harlem Road; and
 
WHEREAS,      by virtue of a GENERAL WARRANTY DEED recorded in the Franklin County, Ohio, Recorder's Office, on December 8, 2003 as Instrument Number 200312080388667, SANDRO TREONZE and PASQUALE A. GIAMMARCO, has deeded property to the City of Columbus, to be used for the right-of-way of Cassady Avenue; and
 
WHEREAS,      by virtue of a GENERAL WARRANTY DEED recorded in the Franklin County, Ohio, Recorder's Office, on December 8, 2003 as Instrument Number 200312080388668, EPCON WINDSOR BRIDGE, LLC, an Ohio limited liability company has deeded property to the City of Columbus, to be used for the right-of-way of Thompson Road; and
 
WHEREAS,      the City desires to accept these deeds for property which will be used for road right-of-way; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.      That the City of Columbus hereby accepts the property more fully described in the attached GENERAL WARRANTY DEED from DOMINION HOMES, INC., an Ohio corporation, and shall be dedicated and named Big Run South Road.
 
Section 2.      That the City of Columbus hereby accepts the property more fully described in the attached LIMITED WARRANTY DEED from MORSO HOLDING CO., a Delaware corporation, and shall be dedicated and named Montclair Drive and Florian Drive.
 
Section 3.      That the City of Columbus hereby accepts the property more fully described in the attached GOVERNER'S DEED from THE STATE OF OHIO, by BOB TAFT, GOVERNER, and shall be dedicated and named Fountain Square Drive.
 
Section 4.      That the City of Columbus hereby accepts the property more fully described in the attached GENERAL WARRANTY DEED from M.H. MURPHY DEVELOPMENT COMPANY, an Ohio corporation, and shall be dedicated and named Harlem Road.
 
Section 5.      That the City of Columbus hereby accepts the property more fully described in the attached GENERAL WARRANTY DEED from SANDRO TREONZE and PASQUALE A. GIAMMARCO, and shall be dedicated and named Cassady Avenue.
 
Section 6.      That the City of Columbus hereby accepts the property more fully described in the attached GENERAL WARRANTY DEED from EPCON WINDSOR BRIDGE, LLC, an Ohio limited liability company, and shall be dedicated and named Thompson Road.
 
Section 7.      That all of these properties shall be used for road right-of-way purposes.
 
Section 8.      That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
