Explanation
BACKGROUND: The Hap Cremean Water Plant (HCWP) was originally constructed in the 1950's with a significant addition constructed in the 1970's. A recently completed asbestos survey identified asbestos containing materials at the facility. This project will accomplish the removal of asbestos from miscellaneous buildings and the replacement of the heating system for the main treatment building at the plant. The insulation on the steam piping lines of the heating system are asbestos containing materials.
The procurement of this contract was conducted in accordance with Section 329.09.
Competitive bids were received and opened at the office of the Director of Public Utilities on October 25, 2006. Of the three (3) bids received, the lowest responsive and responsible and best bidder was Sauer Incorporated. The proposal submitted by the apparent low bidder, General Temperature Control is considered non-responsive due to failure to include a completed proposal bond, as required by Section 102.08 of the CMSC and as amended by SP-24 of the bid documents.

EMERGENCY: Emergency legislation is being requested in order to execute the contract, review and approve the contractors proposed fabrication documents and begin equipment fabrication in time for the March 2007 boiler shut down. The Boiler system is the primary heat source for the HCWP and can only be taken out of service from March thru October. Emergency legislation is also requested in order to expedite the asbestos hazard abatement in the facility.
FISCAL IMPACT: This project is included in the 2006 CIB and $3,300,000.00 is budgeted. Funds are also being transfered within the CIB to fund the contract.

WHEREAS, the Director of Public Utilities did receive and open bids on October 25, 2006 for the Hap Cremean Water Plant, Asbestos Hazard Abatement & Heating System Replacement for the Division of Power and Water (pka the Division of Water), Department of Public Utilities, and
WHEREAS, a satisfactory low bid has been received, and
WHEREAS, The Hap Cremean Water Plant was originally constructed in the 1950's with a significant addition constructed in the 1970's, and
WHEREAS, A recently completed asbestos survey identified asbestos containing materials at the facility, including the insulation on the steam piping lines of the heating system. This project will accomplish the removal of asbestos from miscellaneous buildings and the replacement of the heating system for the main treatment building at the plant, and
WHEREAS, an emergency exists in the usual daily operations of the Division of Power and Water (fka the Division of Water), Department of Public Utilities in that it is immediately necessary to authorize the Director of Public Utilities to enter into a Contract with Sauer Incorporated for the Hap Cremean Water Plant, Asbestos Hazard Abatement & Heating System Replacement, for the Division of Power and Water (pka the Division of Water), to execute the contract, review and approve the contractors proposed fabrication documents and begin equipment fabrication in time for the March 2007 boiler shut down , and in order to expedite the asbestos hazard abatement in the facility, and for the preservation of public health, peace, property and safety, now, therefore;
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
Section 1. That the Director of Public Utilities be and is hereby authorized to enter into a Contract with Sauer Incorporated, in the amount of $3,711,750.00 for the Hap Cremean Water Plant, Asbestos Hazard Abatement & Heating System Replacement, for the Division of Power and Water (pka the Division of Water), Department of Public Utilities, Contract No. 1047, Project 690490,on the basis of the lowest responsive and responsible and best bid received on October 25, 2006.
Section 2. That for the purpose of paying the cost thereof, the expenditure of $3,711,750.00 is hereby authorized from Waterworks Enlargement Voted 1991 Bonds Fund, Fund No. 606, Department of Public Utilities, Division of Power and Water (pka the Division of Water), Dept./Div No. 60-09, Object Level Three 6623, Project No. 690490, OCA Code 606490.
Section 3. The City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project; that the project has been completed and the monies are no longer required for said project except that no transfer shall be so made from a project account funded by monies from more than one source.
Section 4. The City Auditor is hereby authorized and directed to appropriate and transfer funds from within the Waterworks Enlargement Voted 1991 Bonds Fund, Fund No. 606, Department of Public Utilities, Division of Power and Water (pka the Division of Water), as follows:

Section 5. That the 2006 Capital Improvements Budget Ordinance No. 1108-2006 is hereby amended as follows:

Section 6.
