Explanation

1.  BACKGROUND

The purpose of this legislation is to amend an earlier ordinance to facilitate the execution of a Contribution Agreement between the Department of Public Service and the Columbus State Community College Development Foundation Inc. relative to the Miscellaneous Economic Development - Creative Campus Phase 2 project.

 

Ordinance 2896-2017 previously authorized the Director of Public Service to enter into a Design Guaranteed Maximum Reimbursement Agreement with the Columbus State Foundation for the aforementioned Project, which encompasses various improvements to Cleveland Avenue between Long Street and Mount Vernon Avenue, in connection with Columbus State Community College’s new culinary school project. Since that time, the Department of Public Service has determined that it would be more prudent to execute a Contribution Agreement relative to that effort.

 

Additionally, this legislation clarifies that the signatory to the aforementioned Contribution Agreement will be the Columbus State Community College Development Foundation Inc. and corrects the project name. 

 

2.  FISCAL IMPACT

The City previously committed $350,000.00 toward eligible Project design costs, and an Auditor’s Certificate, ACPO002492, has already been established allocating capital funds for that purpose. No additional monies will be encumbered or expended pursuant to this ordinance.

 

3.  EMERGENCY DESIGNATION

Emergency action is requested so as to allow for the immediate execution of the requisite Contribution Agreement, which is necessary to facilitate the design of these improvements, in order to maintain the project schedule and to meet community commitments.

 

Title

To amend Ordinance 2896-2017 so as to authorize the execution of a Contribution Agreement between the Department of Public Service and the Columbus State Community College Development Foundation Inc. relative to design of the Miscellaneous Economic Development - Creative Campus Phase 2 project; and to declare an emergency.  ($0.00)

 

Body

WHEREAS, Ordinance 2896-2017 authorized the Director of Public Service to enter into a Design Guaranteed Maximum Reimbursement Agreement in an amount of up to $350,000.00 with the Columbus State Foundation for costs associated with the design of various improvements to Cleveland Avenue between Long Street and Mount Vernon Avenue in connection with Columbus State Community College’s new culinary school; and

 

WHEREAS, the Department of Public Service has since determined that it would be more prudent to execute a Contribution Agreement with Columbus State related to that effort; and

 

WHEREAS, it is necessary to amend Ordinance 2896-2017 to correct erroneous references and to authorize the execution of Contribution Agreement between the Department of Public Service and the Columbus State Community College Development Foundation Inc. relative to the Miscellaneous Economic Development - Creative Campus Phase 2 project; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to modify the ordinance to authorize the execution of said agreement as soon as reasonably practicable  in order to maintain the project schedule and to meet community commitments; thereby preserving the public health, peace, property, safety and welfare; now, therefore,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That Ordinance 2896-2017 be and hereby is amended as follows:

 

(BACKGROUND)

This ordinance authorizes the Director of Public Service to enter into a Design Guaranteed Maximum Reimbursement Agreement  Contribution Agreement with the Columbus State Community College Development Foundation Inc. in an amount of up to $350,000.00 for the Roadway Improvements Miscellaneous Economic Development - Creative Campus Phase 2 project (the “Project”).

 

The Columbus State Community College Development Foundation Inc. is undertaking the design of the Project, which will result in the construction of various improvements to Cleveland Avenue between Long Street and Mount Vernon Avenue, in connection with Columbus State Community College’s new culinary school project.

 

The purpose of this legislation is to provide for the reimbursement of up to $350,000.00 to the Columbus State Community College Development Foundation Inc. for eligible Project design costs.

 

(CONTRACT COMPLIANCE INFORMATION)

The Columbus State Community College Development Foundation Inc. will be required to become contract compliant before entering into agreement with the City.

 

(EMERGENCY DESIGNATION)

Emergency action is requested so as to allow for the immediate execution of the requisite Design Guaranteed Maximum Reimbursement  Contribution Agreement, which is necessary to facilitate the design of these improvements, in order to maintain the project schedule and to meet community commitments.

To authorize the Director of Public Service to enter into a Design Guaranteed Maximum Reimbursement Contribution Agreement with the Columbus State Community College Development Foundation Inc. in connection with the Roadway Improvements Miscellaneous Economic Development - Creative Campus Phase 2 project; to authorize the expenditure of $350,000.00 within the Streets and Highways Bond Fund; and to declare an emergency. WHEREAS, the Columbus State Community College Development Foundation Inc. is undertaking the design of the Roadway Improvements Miscellaneous Economic Development - Creative Campus Phase 2 project (the “Project”) in connection with Columbus State Community College’s new $33 million culinary school project; and

 

WHEREAS, this ordinance authorizes the Director of Public Service to enter into a Design Guaranteed Maximum Reimbursement  Contribution Agreement in an amount of up to $350,000.00 with the Columbus State Community College Development Foundation Inc. for costs associated with the design of the Project; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize the execution of said Design Guaranteed Maximum Reimbursement Contribution Agreement and the expenditure of said funds in order to maintain the project schedule and to meet community commitments; thereby immediately preserving the public health, peace, property, safety and welfare; now, therefore,

 

(SECTION 1)

That the Director of Public Service be and is hereby authorized to enter into a Design Guaranteed Maximum Reimbursement Contribution Agreement with the Columbus State Community College Development Foundation Inc., P.O. Box 1609 550 E. Spring Street, Columbus, Ohio 43216 43215, pursuant to Section 186 of the Columbus City Charter, relative to the design of the Roadway Improvements Miscellaneous Economic Development - Creative Campus Phase 2 project.

 

(SECTION 2) 

That the expenditure of $350,000.00, or so much thereof as may be needed, is hereby authorized in Fund 7704 (Streets and Highways Bond Fund), Dept-Div 59-12 (Division of Design and Construction), Project P440104-100027 (Roadway Improvements Miscellaneous Economic Development - Creative Campus Phase 2), in Object Class 06 (Capital Outlay) per the accounting codes in the attachment to this ordinance.

 

SECTION 2.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
