PROPOSED USE: Commercial/office/warehouse and storage.  
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (6-0) on July 10, 2003.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  Deviation from The Far North Plan (1994) is justified because the proposed uses include neighborhood scale commercial uses as called for in the Plan.  Additionally, the presence of RI, Restricted Industrial Zoning on the property to the south make this proposal consistent with the established development and zoning pattern of the area.

WHEREAS, application #Z03-014 is on file with the Building Services Division of the Department of Development requesting rezoning of 1.25± acres from R Rural District, to L-M, Limited Manufacturing District respectively; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because deviation from The Far North Plan (1994) is justified because the proposed uses include neighborhood scale commercial uses as called for in the Plan.  Additionally, the presence of RI, Restricted Industrial zoning on the property to the south make this proposal consistent with the established development and zoning pattern of the area, now, therefore:    
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
DESCRIPTION OF 1.252 ACRES FOR ZONING PURPOSES
LOCATED NORTH OF OAK STREET,
AND WEST OF STATION STREET
 
Situate in the State of Ohio, County of Franklin, Township of Sharon, and lying in Township 2, Range 18 of the United States Military Lands, being all of Lots 6, 7, 8, 9, 10 and part of Lot 5 of "VILLAGE OF FLINT", a subdivision of record in Plat Book 1 Page 401, same being all of that 1.252 acres conveyed to Park Storage, Inc. by deed of record in Instrument Number 200109190216062, and by Affidavit of name change in Instrument Number 200211150292060, all records herein of the Recorder's Office, Franklin County, Ohio, said 1.252 acres being more particularly described as follows;
 
BEGINNING, at the southeasterly corner of said Lot 10, also being the common corner of the northerly right-of-way of Oak Street and the westerly right-of-way of Station Street;
 
Thence North 86º 46' 45" West, a distance of 200.00 feet, along the line common to the southerly line of said Lot 10 and the northerly right-of-way of said Oak Street, to a point at the southwesterly corner of said Lot 10;

INTRODUCTION:
The subject property (the "Site") is located along North Oak and West Station Streets on Columbus's far north side. The Site was recently approved for annexation by the Franklin County Commissioners on or about July 15, 2002.  While in the County, the Site was zoned LI, Limited Industrial.  The Applicant is seeking a comparable zoning pursuant to Columbus City Code §3310.09.  In addition, because the structures and certain development standards on the Site already exist, this rezoning is being filed with council variance (CV03-007) to address the pre-existing, non-conforming development standards which should be "grandfathered."  The use, as existing, is "flex space" (small office, small warehouse).  There are 17 existing units, approximately 1200 sq. ft. or less.
 
The Site is surrounded: (1)  to the south by properties zoned LI, Limited Industrial, developed and used as a machine shop; (2) directly east by a 100' wide Conrail railroad track; and (3) immediately north and west by property situated in Franklin County zoned residential.
 
By virtue of the 100' railroad to the east and the manufacturing uses that currently exist in the area, the Applicant considers this re-zoning an appropriate use and zoning classification for this location.
 
1.  PERMITTED USES:
 
The following uses for this LM district, as permitted by C.C.C. §3363.01, et seq., shall be permitted:
 
a).  The following C1, Commercial District uses - dry-cleaning depot; florist shop; magazine and newspaper sales; office uses and office support services as set forth in C.C.C. §3351.
 
b).  The following C2, Commercial District uses - office uses and office support services, as set forth in C.C.C. §3353; art studio; photography studio.
 
c).  The following C3, Commercial District uses - office uses and office support services for uses set forth in C.C.C. §3355; appliance sales and service; dancing school; dry goods or notions store; furniture sales; wallpaper store (which may include home interiors such as custom blinds); hardware store.
 
d).  The following C4, Commercial District uses - office uses and office support services for uses set forth in C.C.C. §3356; book bindery; custom shop; plumbing shop.
 
e).  Uses set forth in §3363.02(a); (b), excluding fuel or paint, unless utilized in the course of another permitted use as stated herein; and (d), except for outdoor storage.
 
f).  The following uses set forth in §3363.04 with respect to the manufacturing, compounding, processing, assembly, packaging or treatment of goods, materials and products: cosmetics and toiletries; ice; including dry ice; ink (mixing only); laboratories, including analytical, commercial analytical, research and experimental; perfumes and perfumed soap (compounding, packaging, or assembly only); pharmaceutical products (compounding processing, packaging, or assembly only); soap; washing or cleaning; powder or soda (compounding only); pottery and pottery/ packaging or assembly; porcelain products.
 
g).  The following uses set forth in §3363.05 with respect to the manufacturing, compounding, processing, assembly, packaging or treatment of goods, materials and products: trailer, motorcycle and bicycle (assembly only); heating; ventilating; cooling and refrigeration supplies and appliances; metal products (fabrication); plumbing supplies; silverware and plated ware; sheet metal products; vitreous enameled products; wagon shop; welding.
 
h).  Uses set forth in §3363.06.
 
i).  Uses set forth in §3363.07 with respect to the manufacturing, compounding, processing, assembly, packaging or treatment of goods, materials and products: bakery products wholesale (manufacturing permitted); candy wholesale (manufacturing permitted); coffee; tea and spices (processing and packaging); condensed and evaporated milk (processing and canning); flour; feed and grain (packaging, blending and storing only); food and vegetable processing (canning, preserving, drying and freezing).
 
j).  The following uses set forth in §3363.08 with respect to the manufacturing, compounding, processing, assembly, packaging or treatment of goods, materials and products: monument shop; plastic products; printing; publishing or engraving (other than as permitted in commercial districts); research and development laboratories; computer laboratories and offices in connection with such laboratories, or other uses of similar character which are not obnoxious or offensive as otherwise defined in the Columbus City Code.      
                                                
1.  DEVELOPMENT STANDARDS:
 
A.  Density, Height, Lot and/or Setback Commitments.
 
N/A
 
B.  Access, Loading, Parking, and/or Other Traffic Related Commitments.
 
1.      Any and all circulation, curb cuts and access points not already existing shall be designated and located to the specifications of the City of Columbus Transportation Division.
 
2.      The Applicant agrees, pursuant to the Station Street Roadway Plans submitted to and approved by the City of Columbus Transportation Division, to improve surrounding roads/alley as follows:
 
a.      Widen Station Street along property frontage, to a minimum twenty (20) feet;
b.      Widen Oak Street from Station Street to the West Alley, to a minimum twenty (20) feet; and
c.      Construct a full-depth alley/roadway, to a minimum eighteen (18) feet width, from Oak Street through to Park Road.
 
3.      The Applicant agrees to install any directional signage determined by the City of Columbus Transportation Division as necessary, along Oak Street, Station Street, or West Alley.
 
4.      The Applicant agrees to install the following stop signs:
 
a.      Northbound on alley, at intersection of West Alley and Park Road; and
b.      Southbound on alley, at intersection of West Alley and Oak Street.
 
 
C.  Buffering, Landscaping, Open Space and/or Screening Commitments.
 
1.  Within the existing Oak Street set back, there shall be landscaping.  Such landscaping may include a combination of grass, plantings, mulch, and/ or decorative trees.
 
2.  At least two ornamental trees shall be installed.
 
3.  Minimum size of all trees at installation shall be 2½ inches caliper for deciduous, 5 feet in height for evergreen, and 1½ inches caliper for ornamental.  Caliper is measured 6 inches from the ground.
 
4.  The landscaping shall be maintained in a healthy state.  Any dead material shall be removed and replaced with like materials within six months or the next available planting season, whichever occurs first.  The size of the new material shall equal the size of the original material when it was installed.  Landscaping materials shall be set forth on the site plan.
 
D.  Building Design and/or Interior-Exterior Treatment Commitments.
 
1.  All building exteriors shall be constructed of wood, brick, real or synthetic stone, real or synthetic stucco, glass, vinyl siding, wood shingles, concrete, marble, textured concrete or any combination thereof.  Split-faced concrete block shall not be permitted except for foundation work/construction.
 
2.  All buildings shall have pitched roofs to a minimum of 6:12 ratio.
 
E.  Lighting, Outdoor Display Areas, and/or other Environmental Commitments.
 
1.  All outdoor lighting, with the exception of security lighting, shall be cutoff down-style fixtures, designated in place to prevent off-site glare where abutting properties are zoned or used residentially.  There may be accent lighting (up lighting) on landscaping and in front of structures or ground signs, provided these fixtures are screened to prevent off-site glare.
 
2.  All external outdoor lighting fixtures shall be from the same or similar manufacturer type/style to promote compatibility.
                                                      
3.  Light poles shall not exceed 28 feet in height, except where located  within 100 feet of a residentially zoned or used property, in which case light poles shall not exceed 14 feet in height.
      
F.  Graphics and/or Signage Commitments.
 
1.  All graphics and signage shall comply with the Graphics Code, Article 15, Title 33, of the Columbus City Code, and any variance from those requirements will be submitted to the City of Columbus Graphics Commission for consideration.
 
G.  Miscellaneous Commitments.
 
1.      The Applicant shall comply with the City of Columbus Parkland Dedication Ordinance.
 
2.      Outdoor storage, per C.C.C. §3363.41, shall not be permitted.
 
 
Section 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
