BACKGROUND:                                          
 
Need: This legislation is needed so State Law Enforcement Seizure Funds can be donated to the Mayor's Office of Education Cap City Kid's Program. O.R.C. § 2933.43(D) requires that municipal corporation police departments use a certain prescribed percentage of state seizure funds in connection with community drug education programs. The Cap City Kid's Program does fund preventive drug abuse programs that are acceptable for receipt of these funds. This donation, by the Division of Police to The Mayor's Office of Education is in compliance with this section of the O.R.C.
 
Additional Need: An additional appropriation of State Law Enforcement Seizure Funds is needed to transfer funds to the Cap City Kids Program and to donate funds to the Children's Hospital Drug Research Unit.
 
EMERGENCY DESIGNATION: Emergency legislation is requested to transfer these funds to this program so funds will be available as soon as possible for their use.

FISCAL IMPACT:
 
Since these funds to be donated are State Seizure Funds, there will be no financial effect on the City's General Fund Account.

Body
 
WHEREAS, O.R.C. § 2933.43(D) requires that a percentage of state seizure funds be spent on community preventive drug abuse education programs; and
 
WHEREAS, funds are being transferred from Police Law Enforcement Drug Seizure funds to the Mayor's Office of Education; and
 
WHEREAS, the Mayor's Office of Education Cap City Kids Program does fund preventive drug abuse programs that are acceptable for receipt of these funds; and
 
WHEREAS, the donation will be given to the Mayor's Office of Education with the stipulation that the funds be used for preventive drug abuse programs; and
 
WHEREAS, an additional appropriation of State Law Enforcement Seizure Funds are needed; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Police, Department of Public Safety, in that it is immediately necessary to transfer funds to the Mayor's Office of Education in order to ensure funding for preventive drug abuse programs, thereby preserving the public peace, property, health, safety and welfare; now therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1. That the Director of Public Safety be and is hereby authorized and directed to donate $70,000.00 to the Mayor's Office of Education Cap City Kids Program for community preventive drug abuse education programs.
 
Section 2. That from the unappropriated monies in the State Law Enforcement Drug Seizure fund, and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2004 the sum of $90,000.00 is appropriated as follows:

Section 3. That the transfer (donation) of $70,000.00, or so much thereof as may be needed, be and same is hereby authorized as follows:

Section 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
