Explanation
 
The purpose of this legislation is to authorize the Director of Public Utilities to modify the contract with Burch Hydro Inc for Land Application of Biosolids Services.
 
This contract provides for the disposal of sewage sludge on agricultural land and ash disposal from the ash lagoon at the Southerly Wastewater Treatment Plant. The contract is utilized by the Compost Facility, Jackson Pike Wastewater Treatment Plant and the Southerly Wastewater Treatment Plant. This contract was entered into for one (1) year with the option for four (4) renewals on a year to year basis upon mutual agreement, availability of funding and Columbus City Council approval. Additional funding in 2007 is needed for ash hauling at the Southerly Wastewater Treatment Plant to clear out the ash lagoon for maintenance and rehabilitation work. The first year of the contract will expire September 30, 2008.
 
The Director of Public Utilities opened formal bids on March 28, 2007: Three (3) bids were received a tabulation of those bids is attached to this ordinance.
 
After review of the bids Burch Hydro Inc was the lowest, responsive and responsible bidder on items number 1, 3, 4, 5A, 5B and 6.

FISCAL IMPACT: $600,000.00 is budgeted and need for this service
 
A total of $1,400,000.00 was spent 2005 and 2006.
 
Emergency legislation is being requested so the ash lagoon at the Southerly Wastewater Treatment Plant can be emptied for maintenance and rehabilitation prior to the onset of cold weather.

Body
 
WHEREAS, the Director of Public Utilities opened bids on March 28, 2007 to provide Land Application of Biosolids Services for the Division of Sewerage and Drainage, and,
 
WHEREAS, three (3) bids were received and it is the recommended that award be made to Burch Hydro Inc for item 1, 3, 4, 5A, 5B and 6, and
 
WHEREAS, this contract provides for  the disposal of sewage sludge on agricultural land and ash removal from the ash lagoon at the Southerly Wastewater Treatment Plant, and
 
WHEREAS, This contract was entered into for one (1) year with the option for four (4) renewals on a year to year basis upon mutual agreement, availability of funding and Columbus City Council approval. Additional funding on this ordinance is to empty the ash lagoon at the Southerly Wastewater Treatment Plant, and
 
WHEREAS,  the first year of this contract will expire September 30, 2008, and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, in that it is immediately necessary to modify the contract for Land Application with Burch Hydro Inc. so the ash lagoon at the Southerly Wastewater Treatment Plant can be emptied for maintenance and rehabilitation prior to the onset of cold weather for the immediate preservation of the public health, peace, property and safety; now, therefore
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1. That the Director of Public Utilities be and is hereby authorized to modify the  contract with Burch Hydro Inc. for Land Application of Biosolids Services for the Division of Sewerage and Drainage.
 
Section 2. That the expenditure of $600,000.00 or so much thereof as may be needed, be and the same hereby is authorized from the Sewerage System Operating Fund, Fund No. 650,

Section 3. That for the reasons stated in the preamble hereto, where is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure, which shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
