Explanation
BACKGROUND: This legislation authorizes the Finance and Management Director to modify and extend a contract on behalf of the Office of Construction Management with Elford Construction Company, Inc. in an amount up to $400,000.00 for the West Side Early Learning Center project located at 45 Clarendon Avenue.
The original contract was authorized by Ordinance No. 2689-2020 and approved by City Council on December 11, 2020. The modification of the contract is necessary to provide additional funding to purchase additional items for the facility such as smartboards, computers, additional security cameras, Matrix Proximity readers, and other fixtures and FFE related supplies and services necessary for full operation of the center located at 45 Clarendon Avenue.
In addition to adding funds, this modification will also extend the contract to December 21, 2023.
Prices already established in the contract were used to determine the cost of this modification.
The contract compliance number for Elford Construction Company, Inc. is 31-4371060 and expires on January 31, 2024.
Emergency action is requested in order to process orders for necessary equipment as soon as possible to so as not to have any interruptions of the schedule and opening of the school.
Fiscal Impact: This ordinance authorizes an appropriation and expenditure of $400,000.00 from the General Permanent Improvement Fund. It is necessary to transfer $400,000.00 between projects within the General Permanent Improvement Fund. Modification of the contract with Elford Construction Company, Inc. is necessary for additional supplies and services for the West Side Early Learning Center project located at 45 Clarendon Avenue. These funds are budgeted within the General Permanent Improvement Fund.

WHEREAS, it is necessary to amend the 2021 Capital Improvement Budget and authorize the transfer of $400,000.00 within the General Permanent Improvement Fund; and
WHEREAS, it is necessary to modify and extend a contract with Elford Construction Company, Inc. in an amount up to $400,000.00 for the West Side Early Learning Center project; and
WHEREAS, the original contract was authorized by Ordinance No. 2689-2020 and approved by City Council on December 11, 2020 for services for the West Side Early Learning Center located at 45 Clarendon Avenue; and
WHEREAS, this modification for additional work is necessary to provide smartboards, computers, security cameras, matrix proximity readers, and other fixtures and FFE related supplies and services necessary for full operation of the West Side Early Learning Center located at 45 Clarendon Avenue; and
WHEREAS, this modification also extends the contract term to December 21, 2023; and
WHEREAS, it is necessary to authorize the expenditure of $400,000.00 from the General Permanent Improvement Fund; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Finance and Management, Office of Construction Management, in that it is necessary to authorize the Finance and Management Director to modify and extend a contract with Elford Construction Company, Inc. so that additional supplies and services for the West Side Early Learning Center project can proceed without delay so that school can start when scheduled, thereby preserving the public health, peace, property, safety, and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Finance and Management Director is hereby authorized to modify and extend a contract, on behalf of the Office of Construction Management, with Elford Construction Company, Inc. for the West Side Early Learning Center project.
SECTION 2. That the 2021 Capital Improvement Budget be amended as follows to establish sufficient authority for this project:

SECTION 3. That the transfer of $400,000.00 or so much thereof as may be needed, is hereby authorized within Fund 7748 (General Permanent Improvement Fund), from Dept-Div 4501, Project P748999-100000 (General Permanent Improvement Fund), Object Class 06 (Capital Outlay) to Dept-Div 4550 (General Permanent Improvement Fund), Project P420100-100001 (West Side Early Learning Center), Object Class 06 (Capital Outlay) per the account codes in the attachment to this ordinance.
SECTION 4. That the expenditure of $400,000.00, or so much thereof that may be necessary in regards to the action authorized in SECTION 1, is hereby authorized in Fund 7748 (General Permanent Improvement Fund), in Dept-Div 4550, P420100-100001 (West Side Early Learning Center), in Object Class 06 - Capital Outlay, per the accounting codes in the attachment to this ordinance.
SECTION 5. That the monies in the foregoing Sections shall be paid upon order of the Director of Finance and Management, and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.
SECTION 6. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 7. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 8. That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.
SECTION 9. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared an emergency measure and shall take effect and be enforced from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
