Explanation
Background: The Transportation Division is responsible for maintaining the City's roadway system in a safe manner. Guardrail and fence repair projects are needed to restore accident damage locations, replace deteriorating structures, and install new structures. This project was bid in compliance with the Columbus City Code and advertised in the Columbus City Bulletin. Bids were received and tabulated on January 13, 2005, by the Transportation Division. Two bid proposals were received as follows:

The Transportation Division recommends the bid award to M. P. Dory Company (contract compliance number 31-1115885 expiring on January 30, 2006) as the lowest, best, most responsive, and most responsible bidder.
Fiscal Impact: The Transportation Division budgeted $250,000 in the 2005 budget within the Municipal Motor Vehicle License Tax Fund. The amounts spent on guardrail and fence repair in 2002, 2003 and 2004 were $245,000.00, $180,000.00, and $182,000.00 respectively.
Emergency action is requested to allow this work to get underway as soon as possible to eliminate dangerous existing conditions in order to promote motorist and pedestrian safety.

WHEREAS, the Transportation Division is responsible for maintaining the City's roadway system in a safe manner; and
WHEREAS, guardrail and fence repair work is needed to restore accident damage, replace deteriorating structures and install new structures; and
WHEREAS, bids were received and tabulated on January 13, 2005, by the Transportation Division for the Guardrail and Fence Repair - 2005 project and a satisfactory low bid was received; and
WHEREAS, funds are budgeted and available for this expenditure; and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that the contract should be awarded so that the work may proceed without delay in order to eliminate existing dangerous conditions and to promote motorist and pedestrian safety, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Public Service Director be and hereby is authorized to enter into contract for the Guardrail and Fence Repair - 2005 project with M. P. Dory Company, 2001 Integrity Drive South, Columbus, Ohio 43209 in an amount not to exceed $250,476.00 in accordance with the applicable specifications and plans on file in the office of the Transportation Administrator, which are hereby approved.
SECTION 2. That for the purpose of paying the cost of the contract the sum of $250,476.00, or so much thereof as may be needed, is hereby authorized to be expended from Fund 266, the Municipal Motor Vehicle License Tax Fund, Department No. 59-09, Transportation Division, Object Level One Code 03, Object Level Three Code 3375 and OCA Code 599115.
SECTION 3. That for the reasons stated in the preamble hereto which is hereby made a part hereof this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
