Explanation
BACKGROUND:
This legislation authorizes the Director of Public Utilities to modify contracts with Kokosing Construction Company, Inc. and DLZ Ohio, Inc. in connection with the Jackson Pike Wastewater Treatment Plant Sludge Handling and Dewatering Improvements Project. This legislation will additionally amend the 2004 Capital Improvements Budget for purposes of increasing the budget authority for the loan proceeds associated with the supplemental loan pending with the Ohio Water Pollution Control Loan Fund.
 
This project provided the installation of new sludge dewatering centrifuges and centrifuge process support systems at the Jackson Pike Wastewater Treatment Plant.  The work to install the new centrifuge system included the removal of existing facilities, improvements to the existing building, improvements to the sludge holding tanks and surrounding site, and installation of an odor control system.  When completed, this project will provide a new high solids centrifuge system to replace the aged, existing equipment which is at the end of its useful life.  In order to provide a complete, operational system, it has become necessary to adjust the work scope to address these changes in order to effectively complete the project.
 
2. CONSTRUCTION CONTRACT MODIFICATION:
The Kokosing Construction Company modification amount requested under this ordinance is $500,000.00.  The contract total including this modification is $14,910,000.00.  These additional funds are necessary to provide for the additional expenses that have been incurred due to the need for additional training, additional instrumentation & control programming, monitoring, communication modification, additional electrical modification, and additional building modification.  Due to the complex and comprehensive nature of this project, this additional work could not be foreseen, and it is not practical or feasible to undertake a new procurement to deliver these services.  The contract work is substantially complete, the Division anticipates that this will be the final request for additional contract funding.
 
3. PROFESSIONAL ENGINEERING SERVICES CONTRACT MODIFICATION:
The DLZ Ohio, Inc. modification amount requested under this ordinance is $218,432.60.  The contract total including this modification is $7,380,669.40 .  The purpose of their original contract was to provide engineering services for the overall design and implementation of the high solids dewatering centrifuge system for the Jackson Pike Wastewater Treatment Plant. The Division has determined that these services cannot be performed by city personnel at this time, and has planned for the procurement of these services on a routine basis.  The cost of these services is consistent with those provided for under the existing agreement.  The work for the Centrifuge Dewatering phase (J201) the contract is substantially complete, and the Division anticipates that this will be the final request for additional funding for this phase.  This contract also includes funding for the Centrifuge Thickening phase (J206) which is currently under construction and is scheduled for completion by the end of 2006.
 
4.  FISCAL IMPACT:
The Division of Sewerage and Drainage is requesting authority to transfer funds from its Sewer System Reserve Fund No. 654 to the Ohio Water Pollution Control Loan Fund No. 666 as a temporary measure that is required to facilitate the immediate execution of the subject work, which is necessary for the successful completion and final implementation of these vital plant processes.  The Division anticipates executing a supplemental loan from the Ohio Water Pollution Control Loan Fund by April of 2005.
 
5.  EMERGENCY DESIGNATION:
The Division of Sewerage and Drainage is requesting City Council to designate this legislation an emergency measure in order to allow for the subject work to continue without interruption, pursuant to the final implementation of these vital wastewater treatment facilities.

Body
WHEREAS, Contract No. EL001713, was authorized by Ordinance No. 1695-01 as passed by Columbus City Council on October 15, 2001 for purposes if authorizing the Director of Public Utilities to execute a construction contract with Kokosing Construction Company associated with the high solids centrifuge system, system start-up, testing, commissioning, and operation instruction and training at the Jackson Pike Wastewater Treatment Plant, in connection with the Jackson Pike Wastewater Treatment Plant Sludge Handling and Dewatering Improvements Project, Dewatering Centrifuges Replacement and Improvements; and
 
WHEREAS, Contract No. CT 19521 was authorized by Ordinance No. 1355-98, as passed by Columbus City Council on June 1, 1998, authorized the Director of Public Utilities to enter into contract with Dodson Stilson, Inc., now known as DLZ Ohio, Inc., for purposes of providing engineering services in connection with the aforementioned project; and
 
WHEREAS, The Division of Sewerage and Drainage engineering personnel have determined it necessary to modify the contract with Kokosing Construction Company,  in order to provide for additional work that is needed to ensure the successful completion of the sludge dewatering centrifuge system improvements phase of the aforementioned wastewater treatment plant capital improvements project; and
 
WHEREAS, The Division of Sewerage and Drainage engineering personnel have further determined it necessary to modify the professional engineering services contract with DLZ Ohio, Inc., in order to provide for continuation of engineering services that are required for the successful completion of the sludge dewatering centrifuge system improvements phase of the aforementioned wastewater treatment plant capital improvements project; and
 
WHEREAS, it is immediately necessary to amend the 2004 Capital Improvements Budget to provide sufficient authority for increasing a capital project account; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, in that it is immediately necessary for this Council to authorize modification of contracts with the Kokosing Construction Company, and DLZ-Ohio, which is necessary to successfully complete the sludge dewatering centrifuge system improvements at the Jackson Pike Wastewater Treatment Plant; for the immediate preservation of the public health, peace, property, and safety; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That from the unappropriated monies in the Sewerage System Reserve Fund 654, and from all monies estimated to come into said fund from any and all sources, and unappropriated for any other purpose during the fiscal year ending December 31, 2005, the sum of $718,432.60 is hereby appropriated to the Division of Sewerage and Drainage, Division 60-05, Object Level One 10, Object Level Three 5502, OCA Code 901553.
 
Section 2.  That the City Auditor is hereby authorized and directed to transfer $718,432.60 to the Ohio Water Pollution Control Loan Fund No. 666, into the appropriate project account as specified within Section 3 herein, at such time as deemed necessary by him, and to expend said funds, or as much thereof as may be necessary.
 
Section 3.  That $718,432.60 is hereby appropriated for the following sanitary sewer system project within Ohio Water Pollution Control Loan Fund No. 666| Division 60-05| Object Level Three No. 6676| as follows:

Section 4.  That upon obtaining other funds for the purpose of funding sanitary sewer system capital improvement work, the City Auditor is hereby authorized to repay the Sewerage System Reserve Fund the amount transferred under Section 2., above, and said funds are hereby deemed appropriated for such purpose.
 
Section 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for any contract or contract modifications associated with the expenditure of the funds transferred under Section 2., above.
 
Section 6.  That the Director of Public Utilities be, and hereby is, authorized to execute a construction contract modification in the amount of $500,000.00, with Kokosing Construction Company. Inc., 886 McKinley Ave, Columbus, Ohio 43222 for the construction of the Jackson Pike Wastewater Treatment Plant Sludge Handling and Dewatering Improvements, Dewatering Centrifuges Replacement and Improvements Project, in order to provide additional services in accordance with the terms and conditions as shown in the Modification on file in the General Engineering Section of the Division of Sewerage and Drainage.
 
Section 7.  That the Director of Public Utilities be and hereby is authorized to execute a contract modification for professional engineering services in the amount of $218,432.60, with DLZ Ohio, Inc. 6121 Huntley Road, Columbus, Ohio  43229-1032, for the Jackson Pike Wastewater Treatment Plant Sludge Handling and Dewatering Improvements Project in accordance with the terms and conditions as shown in the modification agreement on file in the General Engineering Section of the Division of Sewerage and Drainage.
 
Section 8.  That for the purpose of paying the cost of the construction contract modification and the professional engineering services contract modification, the expenditure of $718,432.60, or as much as thereof as may be needed, is hereby authorized as follows from the Ohio Water Pollution Control Loan Fund No. 666| Division No. 60-05| JPWWTP Sludge Handling and Dewatering Improvements Project  No. 650246|OCA Code  650246:

Section 9.  That the 2004 Capital Improvements Budget Ordinance No. 1059-2004 is hereby amended as follows, to provide sufficient budget authority for the project costs covered within the aforementioned contract modifications:

Section 10.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage is the Mayor neither approves nor vetoes the same.
