Explanation

 

BACKGROUNDThis legislation authorizes the Director of Public Safety to enter into an agreement with Air Flite, Inc. to serve as a broker for the sale of the Bell MD530FF N557CP SN071FF helicopter which is no longer in use by the Division of Police.

 

To obtain the highest possible revenue from the sale, the use of a broker is the best possible solution due to the uniqueness of this equipment.  The City of Columbus has used the services of Air Flite, Inc. as a broker in the sale of helicopters for a number of years.  The Department of Public Safety is requesting that the provisions of Chapter 329 of the City Code pertaining to the sale of city-owned personal property be waived.  The Department of Public Safety is also requesting a waiver of the competitive bidding provisions of Chapter 329 pertaining to entering into service contracts.

This company is not debarred according to the Federal excluded parties listing or prohibited from being awarded a contract according to the Auditor of State unresolved findings for recovery certified search.

 

Emergency Designation: This ordinance is being submitted as an emergency measure in order to ensure that the sale of the helicopter can be initiated before Council recess, as additional legislation will be needed to finalize the sale and authorize payment of the broker. Expediting the sale of the helicopter will expedite the receipt of the associated revenue and savings in the City's aviation insurance costs.

 

FISCAL IMPACT: The revenue generated from this sale will be deposited in the Income Tax Set Aside Fund.

 

Bid Waiver: The use of a broker is the best solution to obtain the highest possible revenue due to the uniqueness of this equipment. The City of Columbus has used the services of Air Flite as a broker in the sale of helicopters in 2002, 2006, 2007, 2009, & 2022. The Department of Public Safety is requesting that the provisions of Chapter 329 of the City Code pertaining to the sale of city-owned personal property to be waived. We are also requesting the waiver of competitive bidding requirements for entering into the contract with the broker due to the broker’s familiarity with our helicopter fleet and decades of experience performing this work for the City.

To authorize and direct the Director of Public Safety to enter into a brokerage contract with Air Flite, Inc. for the sale of the Bell MD530FF N557CP SN071FF helicopter no longer in use by the Division of Police; to waive the provisions of Chapter 329 of the Columbus City Codes pertaining to the sale of city-owned personal property, competitive bidding, and to entering into service contracts; and to declare an emergency. Body

WHEREAS, a need exists to sell the Bell MD530FF N557CP SN071FF helicopter which is no longer in use by the Division of Police; and

 

WHEREAS, the use of a broker is the best possible solution due to the uniqueness of this type of sale; and

 

WHEREAS, Air Flite, Inc. has been used previously as a broker to sell the Division of Police's helicopters and has extensive knowledge and experience working with the City on similar sales; and

 

WHEREAS, it is necessary to waive the provisions of Chapter 329 of the Columbus City Codes pertaining to the sale of city-owned personal property and to entering into service contracts; and

 

WHEREAS, an emergency exists in the usual and daily operation of the Department of Public Safety,  Division of Police, in that it is immediately necessary to authorize the Director to enter into contract with Air Flite, Inc. to broker for the sale of a helicopter no longer in use, in order to expedite the sale of the helicopter to ensure that the sale of the helicopter can be initiated before Council recess, as additional legislation will be needed to finalize the sale and authorize payment of the broker and expediting the sale of the helicopter will expedite the receipt of the associated revenue and savings in the City's aviation insurance costs, all for the immediate preservation of the public health, peace, property, safety and welfare, NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Public Safety Director be and is hereby authorized and directed to enter into a contract with Air Flite, Inc. to broker for the sale of the Bell MD530FF N557CP SN071FF helicopter.

 

SECTION 2.  That the funds expended under this contract, which will be appropriated in a future ordinance, shall not exceed $67,500.00 for commission (3% of the estimated $2,250,000.00 sale price) and $6,000.00 for escrow fees (maximum contract obligation of $73,500.00).

 

SECTION 3.  That this Council finds it is in the best interest of the City of Columbus to waive the provisions of Chapter 329 of the Columbus City Codes pertaining to the sale of city-owned personal property and the competitive biding provisions with respect to entering into service contracts, and does hereby waive the same.

 

SECTION 4.  That for reasons stated in the preamble hereto, which is hereby made a part thereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from the after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
