Explanation
 
BACKGROUND:  This resolution appoints a Board of Revision to hear objections that have been made to the Fourth and Elm Parking Facility Special Assessment.
The Charter of the City of Columbus provides City Council with the power by ordinance to provide for the construction, reconstruction, repair and maintenance by contract or directly by the employment of labor, of all local improvements, and to provide for the payment of any part of any such improvement by levying and collecting special assessments upon abutting, adjacent and contiguous or other specially benefited property.  Should a property owner object to an assessment, Charter Section 172 calls for the appointment by City Council of a Board of Revision to hear such objections.

To establish a Board of Revision to hear the objections to the Fourth and Elm Parking Facility Special Assessment, to set a date and time to hear objections and determining that such action is necessary pursuant to Section 55(b) of the Charter of the City of Columbus.
 
 
Body
 
WHEREAS, on July 14, 2008, pursuant to Section 166 of the Columbus City Charter, Council passed  Resolution No. 0132X-2008, declaring the necessity of acquiring, constructing, installing, equipping, or improving off-street parking facilities at the southeast corner of the intersection of Fourth and Elm Streets; and
WHEREAS, This legislation to establish a Board of Revision to hear objections to the Fourth and Elm Parking Facility is another in a series of ordinances subsequent to Resolution No. 0132X-2008 necessary to pay for public improvements such that action hereunder is deemed to be necessary pursuant to Section 55(b) of the Columbus City Charter, now, therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That Eddie Harrell, Kim Gibson and Deborah Diggs, disinterested freeholders and residents of the City of Columbus, Ohio, be and are hereby appointed as a Board of Revision to hear all objections to the estimated special assessments for the Fourth and Elm Street Parking Facility
SECTION 2.  That the time and place for the hearing by such Board of Revision of all such objections to the estimated special assessment is hereby fixed on October 7, 2008 at 6:00 p.m. in City Council Chambers (Conference room 226), 90 West Broad Street, Columbus, Ohio 43215 and that the City Clerk is hereby directed to cause at least one week's notice thereof to given in the City Bulletin.
SECTION 3.  That at the time so fixed, and after taking an oath to faithfully and impartially to discharge its duties, such Board of Revision shall proceed to hear all objections to such estimated special assessment and thereafter shall report to City Council its findings, together with its amendments, if any, of the estimated special assessment as reported by the City Engineer and on file in the Office of the City Clerk.  
SECTION 4. That for reasons set forth in the preamble hereto, which is hereby made a part hereof, and in accordance with Section 55(b) of the Charter of the City of Columbus, this resolution shall take effect and be in force from and immediately after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
