Explanation
 
Background: The City of Columbus is engaged in that project identified as the Seventh Avenue Improvement (4th Street to 6th Street) project.  The purpose of this project is to remove and replace existing pavement between the east side of 4th Street and the west side of 6th Street, to install new 18" curb along both sides of the street, to install 6 foot wide concrete walks along both sides of the street and to install ADA curb ramps at the intersection of 7th Avenue with 5th and 6th Streets.  Preliminary cost estimates for right-of-way acquisition are $25,000.00.  It is anticipated construction of this improvement project will begin in late May 2008.  The following legislation encumbers $25,000.00 for right-of-way acquisition for the Seventh Avenue Improvement project and authorizes the City Attorney's Office, Real Estate Division, to hire professional services relative to the acquisition of the necessary right-of-way, to negotiate with the property owners and to expend the funds required to acquire the necessary right-of-way.
 
Fiscal Impact: Funding in the amount of $25,000.00 is available in the Streets and Highway Improvement Fund for this project.
 
Emergency Justification: Emergency action is requested to allow the Real Estate Division to proceed with those actions that will enable the City to acquire the necessary right-of-way without delay.

WHEREAS, the City of Columbus is engaged in that project identified as the Seventh Avenue Improvement (4th Street and 6th Street) project; and
 
WHEREAS, the purpose of this project is to remove and replace existing pavement between the east side of 4th Street and the west side of 6th Street, to install new 18" curb along both sides of the street, to install 6 foot wide concrete walks along both sides of the street and to install ADA curb ramps at the intersection of 7th Avenue with 5th and 6th Streets; and
 
WHEREAS, construction of this improvement project is currently scheduled to begin in late May 2008; and
 
WHEREAS, to accommodate this schedule all right-of-way acquisition must be completed by April 15, 2008; and
 
WHEREAS, preliminary cost estimates for right-of-way acquisition are $25,000.00; and
 
WHEREAS, funds are available in the Streets and Highway Improvement fund to pay for said acquisition related costs; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that it is immediately necessary to authorize the City Attorney's Office, Real Estate Division, to hire professional services relative to the acquisition of the necessary right-of-way, to negotiate with the property owners and to expend the funds necessary to acquire additional right-of-way for the Seventh Avenue Improvement (4th Street and 6th Street) project for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the City Attorney be and is hereby authorized to acquire fee simple title and lesser interests in and to those parcels of additional right-of-way needed for the Seventh Avenue Improvement (4th Street and 6th Street) project and to expend those funds needed for related acquisition costs.
 
SECTION 2.  That for the purpose of paying for said costs the City Attorney's Office, Real Estate Division is hereby authorized to expend $25,000.00, or so much thereof as may be necessary from the Streets and Highway Improvement Fund as follows:

SECTION 3.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
