Explanation
BACKGROUND:
This legislation authorizes the Franklin County Municipal Court, Clerk of Court ("Municipal Court Clerk") to enter into a contract with and establish a purchase order with AT&T Enterprises, LLC in the amount of $48,000.00 for the purchase of maintenance, support and services for the Municipal Court Clerk’s phone service. The Ohio Bell Telephone Company has been the subject of a corporate reorganization, and this contracts needs to be assigned to AT&T Enterprises, LLC, which is a disregarded entity of AT&T DW Holdings, Inc. The term of the contract is for thirty-six months.
The Municipal Court Clerk is moving towards a VoIP through Microsoft Teams which is a more modern phone system that allows the Municipal Court Clerk’s Office more flexibility when answering public inquiries.
AT&T Enterprises, LLC has a Master Agreement with the City of Columbus. Through the city's Master Agreement, the City of Columbus owns phone numbers used by the Municipal Court Clerk making it impractical to use another vendor and would require additional funds from the City and Municipal Court Clerk. Therefore, it is impractical to bid this service. However, the Master Agreement does not cover the same maintenance, support, and services needed for this contract.
EMERGENCY DESIGNATION:
Emergency legislation is requested for the purchase of maintenance, support and services for phone service for the daily operations of the Municipal Court Clerk.

WHEREAS, it is necessary for the Municipal Court Clerk to establish a contract to purchase maintenance, support and services for phone services for the Municipal Court Clerk’s office from AT&T Enterprises, LLC; and,
WHEREAS, that AT&T Enterprises, LLC provides the standard phone service for the daily operations of the Franklin County Municipal Court; and
WHEREAS, it is in the best interests of the City to waive the competitive bidding provisions of the Columbus City Codes, and
WHEREAS, an emergency exists in the usual and daily operation of the Franklin County Municipal Court, in that it is immediately necessary to authorize the Municipal Court Clerk to establish a contract with AT&T Enterprises, LLC to purchase maintenance, support and services for phone services for the daily operations of the Municipal Court Clerk, all for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Municipal Court Clerk is authorized to establish a contract to purchase maintenance, support and services for phone services from AT&T Enterprises, LLC.
SECTION 2. That this Council finds that it is in the City's best interest to waive the competitive bidding provisions of the City Code to enter into this contract.
SECTION 3. That the expenditure of $48,000.00 or so much thereof as may be necessary is hereby authorized to be expended from Fund 2227 (computer fund), Department/ Division 2601 (Municipal Court Clerk), Object Class - 03 (contractual services) per the accounting codes in the attachment to this ordinance.
SECTION 4. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 5. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 6. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
