Explanation
 
Background:  This legislation authorizes a modification to the design contract with ms consultants, inc. for the Gay Street Traffic Calming General Engineering project.  This project is being designed to convert Gay Street to a two way operation from Front Street to Cleveland Avenue.  This modification provides for additional design involving the water line and sewer work included in the plans on behalf of the Department of Pubic Utilities as well as reestablishing contingency design funds that are currently being used to address various construction issues.  Existing contingency funds have been used to add additional conduit of behalf of the Department of Technology, revise the median in coordination with Franklin County and Midland Garage requests, to absorb the Buckeye Building streetscape into the project on behalf of the Development Department, and to address a variety of construction issues mostly related to unknown utilities.  Additional funds are needed to provide for integrating the south side streetscape on behalf of the Development Department and the Edward's development, additional sewer design near a sewer collapse, and to provide for any other upcoming unanticipated construction issues.  This modification is an addition to the original scope of services but is a continuation of the existing work being performed and would not be practical to contract with a different consultant. Rates are based on the original contract.  ms consultants, inc., contract compliance number 34-6546916 (expires 7/29/2008), was originally selected in accordance with Chapter 329 for professional service contracts.

Emergency action is requested for immediate modification of the design contract for the earliest possible completion of the design to stay on schedule for construction and preserve the safety and welfare of the public.
 
Fiscal Impact:  Funds in the amount of  $10,310.00 are budgeted and available in the Waterworks Enlargement Voted 1991 Bonds Fund, funds in the amount of $45,294.00 are available in the Voted Sanitary Sewer Bond Fund, and funds in the amount of $56,591.00 are budgeted and available in the 1995, 1999, 2004 Voted Streets and highways fund.  An amendment to the 2007 Capital Improvements Budget is also included.

WHEREAS, contract number EL-005933 was authorized by ordinance number 2102-2005, passed March 6, 2006, executed April 12, 2006, and approved by the City Attorney on April 18, 2006; and
 
WHEREAS, it is necessary to modify this contract to complete additional design for the Gay Street Traffic Calming General Engineering project; and
 
WHEREAS, it is necessary to authorize an amendment to the 2007 Capital Improvements Budget for purposes of providing sufficient funding and spending authority for the aforementioned project expenditures; and
 
WHEREAS, it is necessary for this Council to authorize the City Auditor to transfer funds within the Water Works Enlargement Voted 1991 Bonds Fund; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Transportation Division, in that the contract should be modified and increased  immediately so that the work may proceed without delay to maintain existing project schedules, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Service be and is hereby authorized to modify and increase contract no. EL-005933, with ms consultants, inc., to complete the design and construction plans for the Gay Street Traffic Calming General Engineering project in accordance with the plans on file in the office of the Public Service Director.
 
SECTION 2.  That the 2007 Capital Improvements Budget is hereby amended as follows:

SECTION 3.  That the City Auditor is hereby authorized and directed to transfer $10,310.00 from within the Waterworks Enlargement Voted 1991 Bonds Fund, Fund No. 606, for the Division of Power and Water as follows:

SECTION 4.  That for the purpose of paying the cost of the waterline improvements, the sum of $10,310.00 or so much thereof as may be needed, is hereby authorized to be expended from the Waterworks Enlargement Voted 1991 Bonds Fund, Dept/Div. 60-09, OCA code 642900, Object Level 6629, and Project No.  690236.
 
SECTION 5. That for the purpose of paying the cost of the sanitary sewer, identified as Sanitary System Rehabilitation-Gay St. Combined Sewer Rehabilitation, the sum of $45,294.00 or so much thereof as may be needed, is hereby authorized to be expended from the Fund 664| Div. 60-05| Proj: 650404| San. Sys Rehab. - Gay St. Combined | OCA 655266| OL3: 6676.
 
SECTION 6. That for the purpose of paying the cost thereof, the sum of $56,591.00 or so much thereof as may be needed, is hereby authorized to be expended from the 1995, 1999, 2004 Voted Streets and Highways Fund, Fund No. 704, Dept/Div. 59-09, Transportation Division, Object Level One Code 06, Object Level Three 6682, OCA code 644385, and project no. 530161.
 
SECTION 7.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
 
SECTION 8.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
SECTION 9.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 10.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
