Title: To authorize the Director of the Development Department to modify the contract with Zucker Systems by extending the contract period; and to declare an emergency.
Explanation
 
BACKGROUND:  This legislation authorizes the Director of the Department of Development to modify Contract EL007972 with Zucker Systems by extending the contract period for an additional eighteen (18) months. The new ending date will be September 30, 2010, thus making the new Time of Agreement April 1, 2008 through September 30, 2010. This contract is funded through the Development Services Special Revenue Fund and the Public Utilities Enterprise Operating Funds. This contract supports the continued creation and establishment of a One Stop Shop Department with needed post-creation guidance and reporting.
 
This extension is to provide time to allow for follow-up after the creation of the new One Stop Shop Department in order to perform post-creation analysis and reporting. As these post-implementation visits and analysis cannot occur until after the new department is in fact created, the time frame for the contracted services must be extended to accommodate this protracted time frame.
 
This ordinance is presented as an emergency to avoid an interruption of services given the extended time frame the creation of a new department requires and that the original contract end date is March 31, 2009.
 
FISCAL IMPACT: No additional funds will be allocated for this contract modification. The contractor received $299,950 in 2008 from both the Development Services Special Revenue Fund ($209,950) and the Public Utilities Enterprise Operating Funds ($90,000).

WHEREAS, this legislation authorizes the Director of the Department of Development to modify Contract EL007972 with Zucker Systems by extending the contract period for an additional eighteen (18) months; and
 
WHEREAS, the original ending date was March 31, 2009, this extension will provide for a new ending date of September 30, 2010; and
 
WHEREAS, the new Time of Agreement will be April 1, 2008 through September 30, 2010; and
 
WHEREAS, this contract supports the continued creation and establishment of a One Stop Shop Department with needed post-creation guidance and reporting; and
 
WHEREAS, this extension is to provide time to allow for follow-up after the creation of the new One Stop Shop Department in order to perform post-creation analysis and reporting; and
 
WHEREAS, these post-implementation visits and analysis cannot occur until after the new department is in fact created, the time frame for the contracted services must be extended to accommodate this protracted time frame; and
 
WHEREAS, no additional funds will be allocated for this contract modification; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Development in that it is immediately necessary to modify Contract No.EL008135 with Zucker Systems to avoid an interruption of services given the extended time frame the creation of a new department requires and that the original contract end date is March 31, 2009; all for the preservation of the public health, peace, property, safety, and welfare; and NOW, THEREFORE,
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
Section 1.       That the Director of the Department of Development be and is hereby authorized to modify Contract No. EL007972 with Zucker Systems by extending the contract period for an additional eighteen (18) months. The new Time of Agreement will be April 1, 2008 through September 30, 2010.
 
Section 2.      That this contract modification is made pursuant to Section 329.16 of the Columbus Codes.
 
Section 3.      That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten (10) days after passage if the Mayor neither approves nor vetoes the same.
