Explanation
 
1.      BACKGROUND:
 
A.  Need.  This legislation authorizes the Director of Public Utilities to enter into a construction contract modification (Mod # 1) with Dreier & Maller, Inc. for the Clintonville Private Source Inflow and Infiltration (I/I) Project for the Division of Sewerage and Drainage.  Work to be completed by this contract consists of the installation of 120 private sewer laterals utilizing the Cured-in-Place Pipe (CIPP) process which includes installation of pipe clean out, point repairs and lateral tap lining. An installation of up to 70 private sewer laterals will utilize the Cured-in-Place Pipe (CIPP) process which includes installation of clean out, point repairs and lateral tap lining. Additional work under this contract shall be completed in a manner acceptable to the City within 180 calendar days after the effective date of the Notice to Proceed.
 
Amount of additional funds to be expended:  $700,000.00
Original Contract            $ 1,250,160.00

Reasons additional goods/services could not be foreseen:  
The Project Manager and the contractor had an original estimate of 90 participates based on the initial proposal. Do to the success of the project an additional twenty nine residences were added. A time extension to September 17, 2010 was granted to the Contractor to provide time to perform the current work. It was then estimated that there were approximately 70 more proposed residences that would participate in the program if a modification was granted.
 
Reason other procurement processes are not used:  
The competitively bid unit prices will be extended to include the additional participants in the pilot Inflow and Infiltration (I&I) program.
 
How cost of modification was determined:
The contract modification cost are based on the unit price provide in the initial contract.
 
 
The original contract was advertised in the City Bulletin, and bids were received on August 27, 2008.
 
Award was recommended to the lowest and best bidder: Dreier and Maller

2.      FISCAL IMPACT:
 
This ordinance authorizes the transfer and expenditure of funds from within the Sanitary Build America Bonds (B.A.B.s) Fund and to amend the 2010 Capital Improvements Budget to provide sufficient authority for this expenditure upon passage of this ordinance.

Body
 
WHEREAS, the Division of Sewerage and Drainage engineering personnel have determined it necessary to enter into a construction contract modification with Dreier & Maller, Inc., in order to complete the construction of the Clintonville Private Source I/I Project; and
 
WHEREAS, the original Contract No. EL009500 was authorized by Ordinance No. 0374-2009, as passed by Columbus City Council on April 13, 2009, executed on July 14, 2009 and approved by the City Attorney on July 17, 2009 for purposes of authorizing the Director of Public Utilities to enter into a construction contract agreement with Dreier & Maller, Inc., in connection with the Clintonville Private Source I/I Project; and
 
WHEREAS, it is necessary to authorize the transfer of funds within the Sanitary Build America Bonds (B.A.B.s) Fund to provide sufficient funding for the aforementioned project expenditure; and
 
WHEREAS, it is necessary to authorize an amendment to the 2010 Capital Improvements Budget for the purpose of providing sufficient budget authority for the aforementioned project expenditure; and
 
WHEREAS, it is necessary for City Council to authorize the expenditure of funds from the Sanitary Sewer Revenue Bonds Fund; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities in that it is immediately necessary to request that this Council authorize the Director of Public Utilities to execute a construction contract modification with Dreier & Maller, Inc., in connection with the completion of the Clintonville Private Source I/I Project, for the immediate preservation of the public health, peace, property, and safety; Now, Therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of Public Utilities be, and hereby is, authorized to enter into a contract with Dreier & Maller, Inc., 6508 Taylor Road SW, Reynoldsburg, OH 43068, for construction of the Clintonville Private Source I/I Project in accordance with the terms and conditions as shown in the contract on file in the office of the Division of Sewerage and Drainage.
 
Section 2.  That the City Auditor is hereby authorized to transfer and appropriate $700,000.00 within the Sanitary Sewer Revenue Bonds Fund, Fund 668, Object Level Three 6630; Division of Sewerage and Drainage; Div. 60-05:

Section 3.  That the 2010 Capital Improvements Budget Ordinance No. 0564-2010 is hereby amended as follows, to provide sufficient budget authority for the award of the agreement stated herein.

Section 4.  That for the purpose of paying the cost of the construction contract, the following expenditure, or as much thereof as may be needed, be and the same is hereby authorized as follows:  Division 60-05; Fund 668; Clintonville Private Source I/I, Project No. 650405-100002; OCA Code 684502; Object Level 6630; Amount $700,000.00.
 
Section 5.  That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.
 
Section 6.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
Section 7.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
Section 8. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
