Explanation
The City of Columbus, Columbus Water and Power, Division of Water Reclamation supports OhioHealth’s request to transfer ownership of City-owned sanitary sewer to OhioHealth and release the associated City of Columbus easement rights at the location. The sewer consists of 12-inch and 15-inch sewer systems originally built as part of the plan CC17810, that is located approximately 400 ft. from the intersection of West North Broadway and OhioHealth Parkway and extends to south and east through the parcel 010-183740 owned by OhioHealth, as indicated on Exhibit A. The parties are working towards proper approvals, permits and licensing for rerouting the existing sewer as required for the proposed OhioHealth Comprehensive Cancer facility.
A proposed Sanitary Ownership Transfer Agreement between the City of Columbus, Columbus Water and Power and OhioHealth is expected to be signed, outlining responsibilities of each party.
EMERGENCY DESIGNATION: Columbus Water and Power, Division of Water Reclamation respectfully requests this legislation to be considered as an emergency in order to expedite OhioHealth’s ability to take ownership of an existing Columbus-owned sewer for the purpose of rerouting it.
FISCAL IMPACT: No funds are required.

To authorize the Director of Columbus Water and Power to execute those documents necessary to transfer ownership of a sanitary sewer to OhioHealth and vacation of the related easement rights; to authorize the waiver of the requirements of City Code for the sale of City-owned property and to declare an emergency. WHEREAS, The City of Columbus, Division of Water Reclamation (DOWR) supports OhioHealth’s request to transfer ownership of City-owned sanitary sewer infrastructure to OhioHealth. The parties are pursuing this transfer of ownership as a part of requirements for the proposed OhioHealth Comprehensive Cancer facility construction; and
WHEREAS, City of Columbus relinquishes, any and all rights and ownership related to the Sewer, currently owned and maintained by the City of Columbus. The Sewer consists of 12-inch and 15 inch sewer originally built as part of plan CC17810, and is located approximately 400 feet from the intersection of West North Broadway and OhioHealth parkway and extends to the south and east through parcel 010-183740, as indicated on Exhibit A in the attached transfer agreement; and
WHEREAS, The City of Columbus, Division of Water Reclamation (DOWR) seeks to release its easement rights on aforementioned OhioHealth location to facilitate the transfer of ownership; and
WHEREAS, this ordinance requests a waiver of requirements in Chapter 328 of City Code for the sale of City-owned realty to bypass requirements to offer the assets to other City agencies, thus expediting OhioHealth’s ability to take ownership of this sewer; and
WHEREAS, an emergency exists in the usual daily operation of the Division of Water Reclamation, Department of Public Utilities, in that it is immediately necessary to authorize the Director of Public Utilities to execute those documents necessary to transfer ownership of the described sewer to OhioHealth, Columbus, Ohio in order to facilitate the construction of the proposed OhioHealth Comprehensive Cancer Facility; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of the Department of Public Utilities is hereby authorized to execute those documents necessary to transfer ownership of the described sewer to OhioHealth, Columbus, Ohio in order to facilitate the construction of the proposed OhioHealth Comprehensive Cancer Facility; and to declare an emergency. ($0.00)
SECTION 2. That the Director of the Department of Public Utilities is hereby authorized to execute those documents necessary to vacate the described sewer easement.
SECTION 3. That the Council of the City of Columbus finds it is in the best interests of the City to waive City Code Section 328.04 Sale of City-owned realty, and it is hereby waived, to transfer ownership of the existing City of Columbus Sewer to OhioHealth, in order to facilitate the construction of the proposed OhioHealth Comprehensive Cancer Facility.
SECTION 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure, and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
