Explanation
BACKGROUND: Ordinance No. 1075-2008, passed July 14, 2008, authorized the City Attorney to acquire fee simple title, contract for professional services in connection with the Doherty Road 12" Water Line RR Project. It has since been determined that the type of real property interest as stated in the ordinance was incorrect. The correct type of the real property interest that is necessary to the project should be fee simple title and lesser interest. The following legislation amends Ordinance 1075-2008 to correct the type of real property to be acquired to fee simple and lesser interests.
EMERGENCY JUSTIFICATION: Emergency action is requested so that those real property interests necessary to the project may be acquired immediately and without delay.
FISCAL IMPACT: No additional funds are required for this amendment.
Title
To amend Ordinance No. 1075-2008, which passed on July 14, 2008, by changing the real property interest to "fee simple title and lesser interests" in connection with the Doherty Road 12" Water Line RR Project; and to declare an emergency.

WHEREAS, on July 14, 2008, Columbus City Council passed Ordinance No. 1075-2008, authorizing the City Attorney to acquire fee simple title, in connection with the Doherty Road 12" Water Line RR Project; and
WHEREAS, it has since been determined that the type of real property interest as stated in the ordinance was incorrect; and
WHEREAS, the correct name of the real property interest that is necessary to the project should be fee simple title and lesser interest; and
WHEREAS, this ordinance amends 1075-2008 to correct the type of real property to fee simple and lesser interests; and
WHEREAS, an emergency exists in the usual daily operation of the City Attorney's Office, in that it is immediately necessary to authorize the amendment to Ordinance No. 1075-2008, all for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That Section 5 of Ordinance No. 1075-2008 shall be amended to read as follows:
That the City Attorney be, and hereby is, authorized to acquire fee simple title and lesser interests in and to certain parcels of real estate and to contract for the professional services necessary in connection with the Doherty Road 12" Water Line RR Project, #690263.
Section 2. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
