Explanation

BACKGROUND

This legislation will authorize the Director of the Department of Technology on behalf of the Department of Public Safety, Columbus Police Division (CPD), to enter into a sole source contract with Right Stuff Software Corporation for maintenance and support of FMLA/Job Posting Precinct Manager software. Maintenance and support services shall not exceed $54,000.00 for the coverage term period.

 

The FMLA/Job Posting Precinct Manager system is used for the division’s job postings and FMLA tracking.  Ordinance 1812-2018 passed by City Council July 25, 2018 authorized the most recent sole source legislation for maintenance and support through PO024065. However, there have been extensions in the years following which were all below the $50,000.00 threshold.

 

The FMLA/Job Posting Precinct Manager software is a proprietary system from Right Stuff Software Corporation. As such, the City must purchase annual support and maintenance from Right Stuff Software Corporation.  This ordinance is being submitted in accordance with the provisions of sole source procurement of the Columbus Code Codes, Chapter 329.

 

EMERGENCY

This ordinance is submitted as an emergency measure to ensure that the services described herein can continue, as the current contract expired September 1, 2023.

FISCAL IMPACT:  In 2021 and 2022 DoT expended $15,000.00 and $18,000.00, respectively for software maintenance and support on the FMLA/Job Posting Precinct Manager. This year, the cost for software maintenance and support services will be $54,000.00.  Funds are identified and available within the Department of Technology, Information Services Operating Fund. This is a significant increase from 2022 due to increased costs in maintaining the software and for providing the required training at the vendor location.

To authorize the Director of the Department of Technology on behalf of the Department of Public Safety to enter into a sole source contract with Right Stuff Software Corporation for software maintenance and support services associated with the Division of Police's FMLA/Job Posting Precinct Manager software in accordance with the sole source provisions of the Columbus City Codes; to authorize the expenditure of $54,000.00 from the Department of Technology, Information Services Operating Fund; and to declare an emergency ($54,000.00)

 

Body

WHEREAS, it is necessary to authorize the Director of the Department of Technology, on behalf of the Department of Public Safety, to enter into a sole source contract for software maintenance and support services for maintenance and support of the FMLA/Job Posting Precinct Manager system with Right Stuff Software Corporation at a cost of $54,000.00 for the term of one year, starting on September 1, 2023 and ending on August 31, 2024; and  

 

WHEREAS, the FMLA/Job Posting Precinct Manager software is a proprietary system from Right Stuff Software Corporation, therefore, this ordinance is being submitted in accordance with the provisions of sole source procurement of the Columbus City Codes, Chapter 329; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Safety, Division of Police, in that it is immediately necessary to authorize the Director of Technology to enter into a sole source contract with Right Stuff Software Corporation for CPD FMLA/Job Posting Precinct Manager System to avoid disruption of services due to the prior contract having recently expired, thereby preserving the public health, peace, property, and safety; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS

 

SECTION 1. That the Director of the Department of Technology, on behalf of the Director of Public Safety, be and is hereby authorized and directed to enter into a sole source contract with Right Stuff Software Corporation for software maintenance and support services on the FMLA/Job Posting Precinct Manager software for the Division of Police for a term of one year, starting on September 1, 2023 and ending on August 31, 2024.

 

SECTION 2.  That the expenditure of $54,000.00, or so much thereof as may be necessary is hereby authorized to be expended as shown on the attachment to this ordinance. (See attachment 2596-2023EXP):

 

SECTION 3.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 4.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 5:  That this contract is being entered into in accordance with the sole source provisions of the City of Columbus Code, Chapter 329.

SECTION 6.  That for reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
