Explanation
1.  BACKGROUND:
This legislation authorizes the Director of Public Utilities to enter into contract with Fields Excavating, Inc., for the construction of the McDannald Estates Area Assessment Sewer Project, and to pay a maximum of $1,198,816.96 for the construction contract; construction inspection; and prevailing wage coordination services.
 
This project is necessary to construct sanitary sewer improvements for the McDannald Estates subdivision which is located on the northeast side of the City of Columbus along Sunbury Rd., south of State Route 161.
 
2.  BID INFORMATION:
The Director of Public Utilities publicly opened three competitive bid proposals on June 24, 2004.  The results of these bids were Fields Excavating submitted a bid of $1,048,816.96| Complete General Construction -$1,597,223.79| Nickolas M. Savko & Sons-$1,753,531.96.  The Engineer's Estimate for this project was $931,233.20.  Bid is recommended to the lowest, best, responsive and responsible bidder.
 
3.  FISCAL IMPACT:  
This project is being constructed in accordance with the special assessment provisions of the Columbus City Codes.  Funding for this project is being provided by a note from the City of Columbus's Treasury Investment Board (Ord. 1865-2004).  Upon completion of the project, property owners will be notified of their final assessment for the improvements.  After payments have been accounted for, the City will bond the remaining balance of the property owners share of the project.  This bond will then be retired from proceeds from the special assessment receipts included within the individual property owner's property tax bill over a ten year period.

Body
WHEREAS, Resolution 103X-2004, as adopted May 12, 2003, established Columbus City Council's declaration for the necessity to provide sanitary sewer improvements with the McDannald Estates Area Assessment Sewer Project; and declared it necessary for the Director of Public Utilities to cause the preparation of plans and specifications required for the construction of said improvements under an assessment procedure; and
 
WHEREAS, Resolution 380X-2003, as adopted November 3, 2003, respectfully approved the estimated assessment of the cost and expense for improving the McDannald Estates area by installing the sanitary sewers as prepared by the Division of Sewerage and Drainage; and
 
WHEREAS, a Board of Revision was convened for purposes of hearing objections to the aforementioned assessment project, as appointed and acting in pursuance to Resolution 380X-2003, adopted November 3, 2003, whereupon the Board of Revision respectfully approved the estimated assessment of the cost and expense of the sanitary sewer improvements known as the McDannald Estates Area Assessment; and
 
WHEREAS, Ordinance No. 0526-2004 as passed March 29, 2004 declared the determination of Columbus City Council to proceed with the construction of the sanitary sewer improvements associated with the McDannald Estates Area Assessment Sewer Project, in accordance with the assessment procedures set forth by the Columbus City Charter; and
 
WHEREAS, three competitive bids for construction of the McDannald Estates Area Assessment Sewer Project were received on June 24, 2004; and
 
WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to award and execute a contract for the McDannald Estates Area Assessment Sewer Project, and to be authorized to expend sufficient funds for the payment of construction inspection and prevailing wage coordination services associated with the subject project; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities in that it is immediately necessary for this Council to authorize the Director of Public Utilities to execute a contract with Fields Excavating, Inc., for the construction of the McDannald Estates Area Assessment Sewer Project that is urgently needed to eliminate groundwater pollution hazards to the project area; to authorize the appropriation and expenditure of funds; and an amendment to the 2004 Capital Improvements Budget to accommodate said expenditure; for the preservation of the public health, peace, property and safety; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.   That the City Auditor is hereby authorized to appropriate the proceeds of the note issued by authority of Ordinance 1865-2004, for purposes of funding the sanitary sewer improvements for the McDannald Estates Area Assessment Sewer Project| Subfund No. 579| Obj. Level Three 6630| OCA Code 662579| Amount: $1,198,816.96.
 
Section 2.  That the Director of Public Utilities be, and hereby is, authorized to award and execute a contract for the construction of the McDannald Estates Area Assessment Sewer Project, with the lowest, best, responsive and responsible bidder, Fields Excavating, Inc., 177 Township Road 191, Kitts Hill, Ohio 45645, in the amount of $1,048,816,.96 in accordance with the terms and conditions of the Contract on file in the office of the Division of Sewerage and Drainage; to obtain the necessary construction inspection and prevailing wage coordination services and to pay up to a maximum of $150,000.00 thereof.
 
Section 3.  That for the purpose of paying the cost of the construction contract, together with inspection and prevailing wage coordination services for the improvements, the expenditure of $1,198,816.96, or as much thereof as may be needed, is hereby authorized from Division of Sewerage and Drainage No. 60-05| Fund 662| McDannald Estates Sewer Assessment Subfund No. 579| OCA Code No. 662579| Object Level Three No. 6630.
 
Section 4.  That the 2004 Capital Improvements Budget Ordinance No. 1059-2004 is hereby amended as follows, in order to provide sufficient budget authority for the execution of the subject professional engineering services contract modification:

Section 5.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
