Explanation
1.  BACKGROUND:  This legislation authorizes the Director of Public Utilities to execute a contract with the Complete General Construction Company in the amount of $3,644,157.38 for the construction of the following projects:
 
a.  Atwood Terrace/Akola Relief Sewer Project - $1,255,817.25
b.  Atwood Terrace/Weber Road Relief Sewer Project - $1,486,319.23
c.  Loretta Avenue Sanitary Relief Sewer Project - $373,541.85
d.  Genessee Ave. Sanitary Relief Sewer Project - $528,479.05
 
The Director of Public Utilities publicly opened two competititve bid proposals on August 18, 2004.  The results of these bids were Complete General Construction Company submitted a bid of $3,644,157.38 and Kokosing Construction Company submitted a bid of $4,586,111.45.
 
2.  FISCAL IMPACT:  The Ohio Water Development Authority approved a loan to the City for these projects during its October 28, 2004 Board Meeting.  The loan proceeds being appropriated herein include the cost of construction and construction administration services.  The Division is requesting an amendment to the 2004 Capital Improvements Budget to accomodate this expenditure and that of the consultant  
 
2.  EMERGENCY DESIGNATION:  The Division of Sewerage and Drainage is requesting City Council to designate this legisation an emergency measure, in order to allow for the immediate execution of the subject contract.  This project is one of several projects the City is undertaking to fulfill committments contained within the Consent Order executed betweent he City of Columbus and the Ohio Attorney Generals Office.  In order to ensure that the City meets the scheduling constraints of this project, it is imperative that a notice-to-proceed be issued as soon as possible.

Body
WHEREAS, two competitive bids for the construction of the Atwood Terrace/Akola Relief Sewer; the Atwood Terrace/Weber Road Relief Sewer; the Loretta Avenue Sanitary Relief Sewer; Genessee Avenue Sanitary Relief Sewer Projects; were received on August 18, 2004, and
 
WHEREAS, the Ohio Water Development Authority approved a loan to the City of Columbus on October 28, 2004, in the amount of $3,927,072.00, identified as OWDA Loan No. CS392397-01; and
 
WHEREAS, it is immediately necessary for the City Council to both appropriate the proceeds from the aforementioned loan agreement and to authorize the expenditure of funds from the Ohio Water Pollution Control Loan Fund; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Sewerage and Drainage in that is immediately necessary to authorize the Director of Public Utilities to execute a contract for the construction of the aforementioned projects; to appropriate and authorize the expenditure of the proceeds from the aforementioned loan; and to amend the 2004 Capital Improvements Budget pursuant to the construction of this urgently needed sanitary infrastructure; thereby preserving the public health, peace and safety; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the proceeds from the Ohio Water Development Authority Loan No. CS392397-01, for the projects listed within the preamble hereto; and funds from the unappropriated monies in Fund 666, the amount of $3,644,157.38 for the cost of construction service contract, is hereby appropriated to the Division of Sewerage and Drainage, Division 60-05| Fund No. 666| Object Level Three 6630 within the following projects:

Section 2  That the Director of Public Utilities be, and hereby is, authorized to award and execute a contract for the construction of the CS392397-01 with the lowest, and best bidder, the Complete General Construction Company, 1221 E. Fifth Avenue, Columbus, Ohio 43219, in the amount of $3,644,157.38, in accordance with the terms and conditions of the Contract on file in the office of the Division of Sewerage and Drainage.
 
Section 3.  That for the purpose of paying the cost of construction contract, the expenditure of $3,644,157.38, or as much thereof as may be needed, is hereby authorized from the Ohio Water Pollution Control Loan Fund No. 666| Division 60-05| Project 650648| OCA Code 666648| Object Level 3 No. 6630| $1,255,817.25

Section 4.  That the 2004 Capital Improvements Budget Ordinance No. 1059-2004 is hereby amended as follows, in order to provide sufficient budget authority for the execution of the subject construction contract award:

Section 5.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
