Explanation
BACKGROUND: This ordinance authorizes the Director of Finance and Management, on behalf of the Facilities Management Division, to enter into a contract with Hydro Mechanical of Ohio, LLC for the Jerry Hammond Domestic Boiler Replacement Project.
The scope of this project includes the removal, replacement and installation of the boiler at the Jerry Hammond Building, located at 1111 East Broad Street, and other such work as may be necessary to complete the contract, in accordance with the drawings, technical specifications, and City of Columbus Construction and Material Specifications as set forth in the Invitation for Bid (IFB).
CONSTRUCTION CONTRACT AWARD: The project was let by the Facilities Management Division via Vendor Services and Bid Express. Two (2) bids were opened on October 16, 2024 from the following Majority-designated vendors:
1. Hydro Mechanical of Ohio, LLC $132,144.00
2. General Temperature Control $173,700.00
Hydro Mechanical of Ohio, LLC’s bid was deemed the lowest, best, most responsive and responsible bid in the amount of $132,144.00. Majority-owned firm. Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Hydro Mechanical of Ohio, LLC.
SUBCONTRACTOR PARTICIPATION: The ODI-assigned goal for this project is 10%. Hydro Mechanical of Ohio, LLC is using the following subcontractors to meet this goal:

Minority vendor certification was in good standing at the time the bid was awarded.
EMERGENCY DESIGNATION: Emergency legislation is requested for this ordinance so that the boiler can be replaced and in working condition prior to the winter months to avoid any functionality issues during the cold weather.
Fiscal Impact: An amendment to the 2024 Capital Improvement Budget and a transfer of cash within the Construction Management Capital Fund will be necessary for this expenditure.

WHEREAS, two bids for the Jerry Hammond Domestic Boiler Replacement Project were received and opened in the office of the Director of Finance and Management on October 16, 2024; and
WHEREAS, the lowest, best, most responsive and responsible bid was from Hydro Mechanical of Ohio, LLC in the amount of $132,144.00; and
WHEREAS, it is necessary to authorize the Director of Finance and Management to award and execute a construction contract for the Jerry Hammond Domestic Boiler Replacement Project; and
WHEREAS, it is necessary to authorize a transfer and expenditure of funds within the Construction Management Capital Improvement Fund; and
WHEREAS, it is necessary to authorize an amendment to the 2024 Capital Improvement Budget; and
WHEREAS, an emergency exists in the usual and daily operation of the Department of Finance and Management, Facilities Management Division, in that it is immediately necessary to authorize the Director of Finance and Management to enter into contract with Hydro Mechanical of Ohio, LLC for the Jerry Hammond Domestic Boiler Replacement Project so that the boiler can be replaced and in working condition prior to the winter months to avoid any functionality issues during the cold weather, all for the immediate preservation of the public health, peace, property, safety, and welfare; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Finance and Management, on behalf of the Facilities Management Division, is authorized to enter into a contract with Hydro Mechanical of Ohio, LLC for the Jerry Hammond Domestic Boiler Replacement Project, in an amount up to $132,144.00
SECTION 2. That the transfer of $132,144.00 or so much thereof as may be necessary in regard to the actions authorized in SECTION 1, is hereby authorized in Fund 7733 - Construction Management Capital Improvement Fund, in Object Class 06, Capital Outlay, per the accounting codes in the attachment to this ordinance.
SECTION 3. That the expenditure of $132,144.00, or so much thereof as may be necessary in regard to the actions authorized in SECTION 1, is hereby authorized in Fund 7733 - Construction Management Capital Improvement Fund, in Object Class 06, Capital Outlay, per the accounting codes in the attachment to this ordinance.
SECTION 4. That the 2024 Capital Improvement Budget is hereby amended per the accounting codes in the attachment to this ordinance.
SECTION 5. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 6. That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
SECTION 7. That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
SECTION 8. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 9. That for the reasons stated in the preamble hereto, which is hereby made a part thereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
