Explanation
BACKGROUND: The Development Department, Building Services Division, had a Mayor's Emergency whereby a structure presented a real threat to the health and safety of the neighborhood. It was immediately necessary to raze this structure. Failure to do so may have resulted in collateral damage to nearby structures or injury to local residents. A Mayor's Emergency Letter was approved.
S. G. Loewendick & Sons Contractors has been identified through an informal bid process as the contractor who will demolish the structure. Three other vendors were contacted but declined to bid on this project due to the size of the structure and the short timeframe in which the demolition needed to occur.
FISCAL IMPACT: Funds were included within the 2004 Development Services Fund Budget for demolition of structures found to be public nuisances.

To authorize the Director of Development to enter into a contract with S. G. Loewendick & Sons Contractors for the demolition of a structure found to be unsafe in accordance with the provisions of Columbus City Codes, 1959, pertaining to Emergency Waiver of Competitive Bidding; to authorize the expenditure of $62,919 from the Development Services Fund; and to declare an emergency. WHEREAS, the Mayor of the City of Columbus declared an emergency due to the deteriorated condition of the structure located at 245 N. Monroe Avenue; and
WHEREAS, informal bids to demolish this structure were sought; and
WHEREAS, S. G. Loewendick & Sons Contractors submitted the only bid; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Development, Development Services Division, in that it is immediately necessary to authorize a contract with S. G. Loewendick & Sons Contractors for the demolition of the unsafe structure at 245 N. Monroe Avenue, for the preservation of the public health, peace, property, safety and welfare, now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Development Director is authorized to enter into contract with S. G. Loewendick & Sons Contractors for the demolition of the unsafe structure at 245 N. Monroe Avenue on the basis of informal bids received; such being performed pursuant to provisions of Section 329.27 (b) of Columbus City Codes, 1959, and as authorized by the emergency declaration of the Mayor.
Section 2. That the sum of $62,919.00, or so much thereof as may be necessary, be and is hereby authorized to be expended from the Development Services Fund, Fund 240, Division 44-03, Object Level Three 3336, OCA Code 440372.
Section 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and may be in force from and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
