Explanation
Background:  The Public Service Department, Transportation Division, awarded four (4) street resurfacing contracts in 2004 that totaled $12,890,975.51.  Similar activity is anticipated for 2005.  This ordinance authorizes the expenditure of up to $200,000.00 for construction inspection for two (2) future capital improvement projects, ADA-compliant Ramp Installation and Resurfacing.  Pre-engineering inspection activity will be undertaken by the Transportation Division beginning in March 2005 to assist in the generation of bid specifications prior to the projects being advertised for formal competitive bids later in the year.  This activity has the added bonus of efficiently utilizing construction inspection labor during a period of the year that traditionally experiences reduced inspection activity due to adverse weather.  These pre-engineering and inspection costs can be capitalized; this creates income for the Development Services Fund that contributes to the latter's viability.  Similar legislation, Ordinance 2223-2003 passed by City Council on November 10, 2003, authorized a $100,000.00 expenditure for the 2004 resurfacing program.  
 
Fiscal Impact:  It is anticipated that ADA-compliant Ramp Installation and Resurfacing will be budgeted in the Transportation Division's 2005 capital improvement program.  Funding for this pre-engineering activity is available within the Transportation Division's 2004 Capital Improvement Budget in the 1995, 1999 Voted Streets and Highways Fund in the Resurfacing project.
 
Emergency action is requested to establish a means of billing these construction inspection expenses to the appropriate capital project as soon as possible to maintain Development Services Fund cash flow and viability and to keep the anticipated projects on schedule.

Body
WHEREAS, the ADA-compliant Ramp Installation and Resurfacing projects will be undertaken in 2005 by the Transportation Division; and
 
WHEREAS, pre-engineering inspection activity will begin in early 2005 to assist in the generation of bid specifications prior to the projects being advertised for formal competitive bids; and
 
WHEREAS, these pre-engineering and inspection costs can be capitalized; and
 
WHEREAS, this activity creates income to the Development Services Fund that contributes to that Fund's viability; and
 
WHEREAS, an emergency exists in the usual daily operation of the Transportation Division, Public Service Department, in that it is immediately necessary to establish encumbrances against which to bill these costs as soon as possible in order to maintain Development Services Fund cash flow and viability and to keep the anticipated projects on schedule, thereby preserving the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Public Service Director be and hereby is authorized to establish encumbrances as appropriate to pay construction inspection charges related to the 2005 ADA-compliant Ramp Installation and 2005 Resurfacing projects that will be undertaken by the Transportation Division.
 
SECTION 2.  That the expenditure of $200,000.00 or so much thereof as may be needed be and hereby is authorized from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No.59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6687, OCA Code 644385, Project 530282 for this purpose.
 
SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
