Explanation
 
1.      BACKGROUND:
 
A.  Need:  This legislation authorizes the Director of Public Utilities to modify the original construction contract with United Survey, Inc. for the Torrence/Colerain Area Sanitary Improvements Project. The United Survey, Inc. modification amount requested under this ordinance is $7,556.85.  The contract total including this modification is $1,107,412.89.  This contract modification is to pay for the replacement of traps that existed in the catch basins.  These traps were not visible during the initial survey work and were discovered upon removal of the catch basin casting.  These traps are not common in storm sewers.  The old clay traps had to be broken off and then replaced with PVC traps to allow other contract work to take place.  The contract modification as a Stormwater expense is necessary due to the Stormwater implications that were not apparent at the time of the initial contract.  This legislation will additionally authorize the transfer of funds, amendment to the CIB, and expenditure of funds within the Storm Sewer Bond Fund.
 
B.  Contract Compliance No.:  34-0894532 (MAJ)
 
C.  Fiscal Impact:  There is sufficient cash and authority for this modification in the fund; however, a transfer of cash and amendment of authority within the 2006 Capital Improvements Budget is needed to place the amounts in the correct project.
 
D.  Emergency Designation:  The Division of Sewerage and Drainage hereby requests City Council to concur in the designation of this ordinance as an emergency measure, to assure that the construction contract work may continue uninterrupted, to avoid delays, and to pay the contractor in a timely manner.
 
 
Title
 
To authorize the Director of Public Utilities to modify a contract with United Survey, Inc. for the Torrence/Colerain Area Stormwater Improvements Project; to authorize the cash transfer of $7,556.85 within the Storm Sewer Bond Fund; to amend the 2006 Capital Improvements Budget; to authorize the expenditure of $7,556.85 within the Storm Sewer Bond Fund for the Division of Sewerage and Drainage; and to declare an emergency. ($7,556.85).
 
 
Body
 
WHEREAS, Contract No. EL005860 was authorized by Ordinance No. 0067-2006, as passed by Columbus City Council on February 6, 2006 for purposes of authorizing the Director of Public Utilities to enter a construction contract with United Survey, Inc. for the Torrence/Colerain Area Sanitary Improvements Project; and
 
WHEREAS, The contract modification of EL005860 as a Stormwater expense is necessary due to the Stormwater implications that were not apparent at the time of the initial contract; and
 
WHEREAS, it is necessary to authorize an amendment to the 2006 Capital Improvements Budget for the purpose of providing sufficient spending authority for the aforementioned project expenditure; and
 
WHEREAS, it is necessary to authorize the transfer of monies within the Storm Sewer Bond Fund to provide sufficient funding for the aforementioned project expenditure; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, in that it is immediately necessary for this Council to authorize the Director of Public Utilities to modify the construction contract for the Torrence/Colerain Area Stormwater Improvements Project, at the earliest practical date to assure that the construction contract work may continue uninterrupted and avoid delays, for the immediate preservation of the public health, peace, property, and safety; Now, Therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of Public Utilities be, and hereby is, authorized to modify Contract No. EL005860 with United Survey, Inc., 25145 Broadway Avenue, Cleveland, Ohio 44146 for construction of the Torrence/Colerain Area Stormwater Improvements Project in order to provide for additional work in accordance with the terms and conditions as shown in the Modification on file in the office of the Division of Sewerage and Drainage.
 
Section 2.  That for the purpose of paying the cost of the construction contract modification, the following expenditure, or as much thereof as may be needed, be and the same is hereby authorized as follows:  Division 60-15; Fund 685; Project-Torrence/Colerain Area Stormwater Improvements, Project No. 611007; Object Level3 6621; OCA Code 681007; Amount $7,556.85.
 
Section 3.  That the 2006 Capital Improvements Budget Ordinance No. 1108-2006 is hereby amended as follows, to provide sufficient budget authority for the execution of the cost agreement increase stated in Section 1 herein:

Section 4.  That the City Auditor is hereby authorized to transfer $7,556.85 within the Storm Sewer Bond Fund, Fund 685, Division of Sewerage and Drainage, Division 60-15, Object Level 3 6621;

Section 5.  That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.
 
Section 6.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
Section 7.   That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
Section 8.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure which shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
