Explanation
1.Background
In 2003, pursuant to Ordinance 0753-03 the City of Columbus transferred a portion of Winton Road within a Quitclaim Deed per instrument number 200210230339950 in Franklin County and subject to a general utility easement. The Department of Public Service recently received a request from the property owner, 919 Old Henderson LLC, asking that the City release this easement over the property they own within this area to clear title so the site can be redeveloped. After receiving this request, the Department of Public Service Division of Infrastructure Management verified with all public and private utility companies that there are no public utilities or need for this easement, located within the requested area, and that they have no objections to this portion of easement being released.
The following legislation authorizes the Director of the Department of Public Service to execute those documents necessary to release the portion of easement as described below and within the attached exhibit, to allow for the property to clear title so the site can be redeveloped.
2.Fiscal Impact
The City will receive a total of $500.00, to be deposited in Fund 7748, Project P537650, for granting the request to release the easement.

WHEREAS, in 2003, pursuant to Ordinance 0753-03 the City of Columbus transferred a portion of Winton Road within a Quitclaim Deed per instrument number 200210230339950 in Franklin County and subject to a general utility easement; and
WHEREAS, the Department of Public Service recently received a request from the property owner, 919 Old Henderson LLC, asking that the City release this easement over the property they own within this area to clear title so the site can be redeveloped; and
WHEREAS, the Department of Public Service Division of Infrastructure Management verified with all public and private utility companies that there are no public utilities or need for this easement, located within the requested area, and that they have no objections to this portion of easement being released; and

WHEREAS, a value of $500.00 for the encroachment easements was established; NOW, THEREFORE;
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. To authorize the Director of the Department of Public Service to execute those documents necessary for the City to release the portion of easement as described below and within the attached exhibit, to allow for the property to clear title so the site can be redeveloped:
A 0.298 Acre Easement Areas to be released:
Situated in the State of Ohio, County of Franklin, City of Columbus, Quarter Township 2, Township 1, Range 18 and 19, United States Military District and containing 0.298 acre of land, said 0.298 acre being part of that 0.313 acre tract of land as conveyed to 919 Old Henderson LLC of record in Instrument No. 202405170048770 and being a vacation of the perpetual general utility easement as described in said Instrument No. 200310230339950, said 0.298 acre being more particularly described as follows; Beginning, at the southwesterly corner of said 0.313 acre tract, also being a westerly corner of that 0.280 acre tract of land also conveyed to 919 Old Henderson LLC of record in Instrument No. 202405170048770 and in the easterly right-of-way line of Midwest Drive; Thence with the westerly line of said 0.313 acre tract and said easterly right-of-way line, N 02° 26' 21" E, 51.13 feet to the northwesterly corner of said 0.313 acre tract and a southwesterly corner of a third tract of land conveyed to 919 Old Henderson LLC of record in Instrument No. 202405170048770, also being the southwesterly corner of Lot 23 of Midwest Boulevard of record in Plat Book 15, Page 30; Thence with the northerly line of said 0.313 acre tract, southerly line of said third 919 Old Henderson LLC tract and Lots 23-27, inclusive, of said Midwest Boulevard, N 67° 09' 55" E, 275.42 feet to a point; Thence across said 0.313 acre tract, S 09° 13' 47" E, 47.59 feet to a southerly line of said 0.313 acre tract and northerly line of said 0.280 acre tract; Thence S 67° 10' 09" W, with the common line of said 0.313 acre tract and said 0.280 acre tract, 286.05 feet to the TRUE POINT OF BEGINNING, containing 0.298 acres, more or less. The above description was prepared by Advanced Civil Design Inc. and based on existing Franklin County records. A drawing of the above description is attached hereto and made a part thereof. All references used in this description can be found at the Recorder’s Office Franklin County, Ohio.
SECTION 2. That the City Attorney is required to approve all instrument(s) associated with this ordinance prior to the director of the Department of Public Service executing and acknowledging any of those instrument(s).
SECTION 3. That the City will receive a total of $500.00 to be deposited in Fund 7748, Project P537650, for granting the requested easement.
SECTION 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
