Explanation

 

BACKGROUND:  This legislation authorizes the Finance and Management Director to enter into a contract on behalf of the Office of Construction Management with Beinhower Brother's Drilling for the installation of geothermal underground water wells located at City Ha1l, 90 West Broad Street and 120 West Gay Street.  Installation of geothermal underground water wells is necessary to utilize underground water to reduce electric and potable water consumption for the HVAC systems that will serve City Hall and the 120 West Gay Street building.  Installation of these wells will also meet all Leadership in Energy and Environmental Design (LEED) requirements to accommodate future renovation projects that will occur at City Hall and 120 West Gay Street. 

 

Formal bids were solicited and three firms submitted bids on March 3, 2011 as follows (0 MBE, 0 FBE):

 

Beinhower Brother's Drilling                     $199,100.00

Moody's of Dayton                                           $219,000.00

Jamison Well Drilling                                          $257,474.00

 

The Office of Construction Management recommends the bid award be made to the most responsive and responsible and best bidder, Beinhower Brother's Drilling.

 

EMERGENCY ACTION is requested for the installation of the geothermal underground water wells located at City Hall, 90 West Broad Street and 120 West Gay Street are completed as soon as possible, to meet the operational needs of said facilities.  

 

Beinhower Brother's Drilling Contract Compliance No. 31-1617685, expiation date June 29, 2011.

 

Fiscal Impact:  The cost of this contract is $199,100.00.  Funding is available in the Construction Management Capital Improvement Budget, Old Police Headquarters.

To authorize the Finance and Management Director to enter into a contract on behalf of the Office of Construction Management with Beinhower Brother's Drilling for the installation of geothermal underground water wells located at City Hall, 90 West Broad Steet and 120 West Gay Street; to authorize the expenditure of $199,100.00 from the Construction Management Capital Improvement Fund; and to declare an emergency.  ($199,100.00)

 

Body

 

WHEREAS, it is necessary for the installation of the geothermal underground water wells located at City Hall, 90 West Broad St and 120 West Gay Street to occur; and

 

WHEREAS, Beinhower Brother's Drilling is the most responsive, responsible, and best bidder to complete the installation of the geothermal underground water wells; and

 

WHEREAS, an emergency exists in the usual daily operation of the Finance and Management Department, Office of Construction Management, in that immediately necessary to authorize to Finance and Management Director to enter into a contract with Beinhower Brother's Drilling for the installation of the water wells located at City Hall, 90 West Broad Street and 120 West Gay Street, to meet the operational needs of said facilities, thereby preserving the public health, peace, property, safety, and welfare; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Finance and Management Director is hereby authorized to enter into a contract on behalf of Office of Construction Management with Beinhower Brother's Drilling for the installation of the water wells at City Hall, 90 West Broad Street and 120 West Gay Street.

 

SECTION 2.  That the expenditure of $199,100.00, or so much thereof as may be necessary in regard to the action authorized in SECTION 1, be and is hereby authorized and approved as follows:

SECTION 3.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.

 

SECTION 4.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 5.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
