Explanation
1. BACKGROUND:
This legislation authorizes the Director of Public Utilities to enter into contract with Storts Excavating, Inc., for the construction services associated with the Sanitary System Rehabilitation-Governor's Place Sanitary Sewer Project, and to pay a maximum of $79,263.75. This project will relocate an existing sewer that crosses the Columbus Foundation property on E. Broad St. without an easement to do so. The relocation will place the sewer within the right-of-way.
2. FISCAL IMPACT:
The project accounts from which funds are being transferred from within this ordinance are residual funds from projects that will be funded through and OWDA Loan.

WHEREAS, the Director of Public Utilities publicly opened and read four competitive bids for the construction of the Sanitary System Rehabilitation-Governor's Place Sanitary Sewer Project were received on May 5, 2004; and
WHEREAS, it is necessary for this City Council to authorize the Director of the Department of Public Utilities to award and execute a contract to fund the payment of construction services for the Sanitary System Rehabilitation-Governor's Place Sanitary Sewer Project; to authorize the appropriation and transfer of the required funds within the 1991 Voted Sanitary Bond Fund; at the earliest practicable date, now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the City Auditor is hereby authorized and directed to appropriate a total of $79,263.75 within the 1991 Voted Sanitary Bond Fund No. 664 as follows:

Section 2. That the City Auditor is hereby authorized and directed to transfer $79,263.75 from within the 1991 Voted Sanitary Bond Fund No. 664, for the Division of Sewerage and Drainage as follows:

Section 3. That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
Section 4. That the Director of Public Utilities be, and hereby is, authorized to award and execute a contract for construction of the Sanitary System Rehabilitation-Governor's Place Sanitary Sewer Project, with the lowest and best bidder, Storts Excavation, Inc., 1167 McCarley Drive West, Columbus, Ohio 43228, in the amount of $79,263.75 in accordance with the terms and conditions of the Contract on file in the office of the Division of Sewerage and Drainage.
Section 5. That for the purpose of paying the cost of construction contract, the expenditure of $79,263.75, or as much thereof as may be needed, is hereby authorized within the 1991 Voted Sanitary Bond Fund No. 664| Project: Sanitary System Rehabilitation| Proj. No.: 650404| OCA Code 655266| Object Level Three No.: 6630| Amount:$79,263.75.
Section 6. That this ordinance shall take effect and be in force from and after the earliest period allowed by law
