BACKGROUND:  This ordinance authorizes the Finance and Management Director to enter into contract for the Facilities Management Division with Miller Pavement Maintenance, Inc., in the amount of $296,000.00 for the renovation of various asphalt parking lots for the Police Division.  The work will include asphalt patching, asphalt milling/replacement, repair and replacement of concrete curbing/sidewalks, asphalt overlays, and the replacement of concrete parking blocks.  The improvements will be made at the following locations: 2609 McKinley Avenue, 2070 Sullivant Avenue, 3022 Winchester Pike, 544 East Woodrow Avenue, 5030 Ulry Road, and 5400 Olentangy River Road.  The contractor has two hundred twenty (220) calendar days upon notification of the award of the contract to complete the project.  
 
Formal proposals were solicited on October 31, 2005.  Six firms submitted proposals on November 15, 2005 as follows:  (1 MBE*, 0 FBE).

It is the recommendation of the Facilities Management Division to award this contract to the most responsive and responsible bidder, Miller Pavement Maintenance, Inc.
 
Emergency action is requested so that the contractor will be able to complete important temporary asphalt patching as quickly as possible.  Current holes in two asphalt lots pose a potential injury-risk to Police Division staff.  
 
Fiscal Impact:  The Police Division budgeted $460,000.00 in the Capital Improvement Budget for this project.  The cost of this contract is $296,000.00.  Miller Pavement Maintenance, Inc. Contract Compliance #31-0831781, exp. 08/27/2007.

Body
 
WHEREAS, various asphalt lots at Police Division locations are in disrepair and in need of repair and replacement, and  
 
WHEREAS, the Facilities Management Division recommends acceptance of the bid submitted by Miller Pavement Maintenance, Inc. as the most responsive and responsible bid, and
WHEREAS; an emergency exists in the usual daily operation of the Facilities Management Division in that it is immediately necessary to authorize the Finance and Management Director to enter into contract with Miller Pavement Maintenance, Inc. for asphalt renovations at various Police Division locations, thereby preserving the public health, peace, property, safety, and welfare; now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Finance and Management Director is hereby authorized to contract with Miller Pavement Maintenance, Inc. for the renovation of various asphalt lots at Police Division locations.
 
SECTION 2.   That the expenditure of $296,000.00, or so much thereof that may be necessary in regard to the action authorized in SECTION 1, be and is hereby authorized and approved as follows:

SECTION 3.
