Explanation
Background: This legislation authorizes the Public Service Director to modify and increase a construction contract for the Transportation Division with Miller Pavement Maintenance, Inc. for the Spring Resurfacing 2001 project in the amount of $1,074.29. The project involved the resurfacing of 48 streets throughout the city. The project included the construction of curbs, pavement renovations and resurfacing. The curb ramps constructed on these streets were a part of a separate contract. This contract is being modified to provide for additional quantities needed to complete the construction and to pay for the administrative costs associated with a claim by the contractor. The additional work was performed at the request of the Transportation Division. WHEREAS, contract EA031215 was authorized by Ordinance No. 1026-01 passed on June 19, 2001 executed on July 23, 2001 and approved by the City Attorney on July 25, 2001, and
WHEREAS, it is necessary to modify this contract to provide for additional work and to pay the costs associated with a claim by the contractor for the Spring Resurfacing 2001 project, and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that the contract should be modified and increased immediately so that the project may be finaled without delay, thereby preserving the public health, peace and safety; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Public Service Director be and hereby is authorized to modify and increase contract EA031215 with Miller Pavement Maintenance, Inc., 1771 Harmon Avenue, Columbus, OH 43223, by $1,074.29 for additional work in accordance with the terms as shown on the modification on file in the office of the City Engineer, which are hereby approved.
SECTION 2. That the sum of $1,074.29 or so much thereof as may be needed is hereby authorized to be expended from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, as follows:

SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
