Explanation
 
Background:  The Transportation Division is responsible for maintaining the City's roadway system.  To accomplish this mission, the Division requires two salt barns for the storage of rock salt that is used when snow and ice conditions are prevalent.  These salt barns will each have the capacity to store 5,000 tons of rock salt.  They will be constructed at the Roberts Road Outpost located 4380 Currency Drive and at the Marion Road Outpost located at 2260 Lockbourne Road.  Additional salt storage capacity will lessen the adverse impact of delivery delays during adverse weather and/or periods of high demand for this commodity.
 
In order that the salt barns are built in time for use during the upcoming winter season it is necessary to wave the competitive bidding provisions of the City Code to obtain plans and specifications for the salt barns.  The construction of the salt barns will need construction plans designed by Advanced Storage Technology, Incorporated, contract compliance number 16-1269023 (expires September 8, 2007).  This company was responsible for the plans that were utilized to construct salt barns located at the main maintenance facility at 1850 East 25th Avenue and the North Outpost at 500 Scherers Court.  The purchase price reflects the plans being certified by an Ohio-licensed architect; these will comply with all City of Columbus building regulations and codes.  These plans will be used to formally bid the actual construction of the salt barns.
 
Fiscal Impact:  The Transportation Division budgeted $2.95 million for facilities improvements in the 2004 Capital Improvements Budget (CIB).  All but approximately $20,000 of these funds have been spent or encumbered since the July 2004 bond sale.  This ordinance will authorize an expenditure of $17,500.00.
 
Emergency action is requested to ensure that the salt barn plans are available as soon as possible.

Body
 
WHEREAS, the Transportation Division is responsible for the maintenance of the City's roadway system; and
 
WHEREAS, the Transportation Division is in need of certified architectural drawings for the construction of two 5,000 ton capacity salt barns for the storage of rock salt that is used when snow and ice conditions are prevalent; and
 
WHEREAS, it is necessary to waive the competitive bidding requirements of the Columbus City Code for this purchase; and
 
WHEREAS, funds are budgeted and available in the 1995, 1999 Voted Streets and Highways Fund for this expense; and
 
WHEREAS, an emergency exists in the usual daily operations of the Public Service Department, Transportation Division, in that it is immediately necessary for the Public Service Director to enter into contract with Advanced Storage Technology for the design of two salt barns, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Public Service Director is hereby authorized to enter into contract with Advanced Storage Technology, Incorporated, 460 East Market Street, Elmira, New York 14901 for the design of two 5,000 ton capacity salt barns.
 
SECTION 2.  That in accordance with Section 329.27 of the Columbus City Code, City Council has determined that it is in the best interest of the City of Columbus that Section 329.06 relating to formal competitive bidding requirements be waived and hereby waives said section.
 
SECTION 3.  That the sum of $17,500.00, or so much thereof as may be necessary, be and hereby is authorized to be expended from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6681, OCA Code 644385 and Project 590130.
 
SECTION 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
