Explanation   

1.  BACKGROUND

This ordinance authorizes the Director of Public Utilities to enter into a contract through the City’s RFP process with Patrick Engineering, Inc. for Comprehensive Master Planning Consulting Services for the Division of Power project, CIP#670100-100001, in the amount up to $205,786.15.

                     

The purpose of this contract is to provide consulting services to the Division of Power resulting in the development of a comprehensive strategic ten-year Master Plan Roadmap. This plan will address evolving challenges in the electric utility industry. Advancing this effort promptly will help ensure the city's continued ability to provide affordable and reliable power to residents while supporting long-term sustainability goals

TIMELINE:  The schedule for this project has an anticipated duration of 12 months but will last until the plan is completed and accepted by the Division of Power. 

 

ESTIMATED COST OF PROJECT:  The bid amount and proposed award amount is $205,786.15, including a 15% design contingency amount that will be utilized to fund needed and approved changes in the work.  No contract modifications are anticipated at this time.

2.  ECONOMIC IMPACT/ADVANTAGES; COMMUNITY OUTREACH; PROJECT DEVELOPMENT; ENVIRONMENTAL FACTORS/ADVANTAGES OF PROJECT

The development of a Division of Power comprehensive strategic plan will help ensure the city's continued ability to provide affordable and reliable power to residents while supporting long-term sustainability goals. Successful implementation of master plan goals will help ensure future electric rate affordability for customers while system reliability improvements will minimize any economic impacts due to power outages.

 

3.  BID INFORMATION

This project was formally advertised on the Vendor Services and Bonfire websites from July 15, 2024, through August 16, 2024.  One proposal was received:

The proposal was deemed responsive.  The evaluation committee reviewed the proposals and recommended the contract for Comprehensive Master Planning Consulting Services for the Division of Power project be awarded to Patrick Engineering, Inc.

 

Patrick Engineering, Inc’s certification was in good standing at the time of the contract award.

 

4.  CONTRACT COMPLIANCE INFORMATION

Patrick Engineering, Inc’s contract compliance number is CC-007237 and expires 04/16/2026. 

 

5.  MINORITY AND WOMAN OWNED BUSINESS ENTERPRISE & SMALL LOCAL BUSINESS ENTERPRISE PROGRAM

This contract opportunity was submitted to the City’s Office of Diversity and Inclusion (ODI) for review and assignment of an MBE/WBE goal prior to bidding.  ODI determined there was not an opportunity for MBE/WBE participation in this contract and did not assign a goal.  This contract was not bid with a City of Columbus MBE/WBE Program goal and the requirements of the City’s MBE/WBE Program are not applicable to this contract.  Patrick Engineering, Inc is classified by ODI as a majority company and plans to do this work without subconsultants.  The MBE/WBE percentage for this contract is anticipated to be 0.0%.

 

6.  FISCAL IMPACT

Funding in the amount of $205,786.15 is available and appropriated within the Electricity Bond Fund, Fund 6303.  An amendment to the 2024 Capital Improvement Budget is needed to align budget authority with the proper project.  A transfer of cash and appropriation between projects within the Electricity Bond Fund is needed to align cash and appropriation with the proper project.

 

7.  EMERGENCY ACTION

Emergency action is requested for this ordinance to allow the Division of Power to quickly address evolving challenges in the electric utility industry to continue to provide affordable and reliable power to residents.

Body

WHEREAS, the Department of Public Utilities is engaged in the Comprehensive Master Planning Consulting Services for the Division of Power project; and

 

WHEREAS, one proposal for the Comprehensive Master Planning Consulting Services for the Division of Power project was received and evaluated by the evaluation committee; and

 

WHEREAS, the evaluation committee recommended Patrick Engineering, Inc., be awarded the contract for this project; and

 

WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to enter into a professional services contract with Patrick Engineering, Inc., for the Comprehensive Master Planning Consulting Services for the Division of Power project; and

 

WHEREAS, the 2024 Capital Improvements Budget must be modified to align budget authority with the proper project; and

 

WHEREAS, it is necessary to transfer cash and appropriation between projects within the Electricity Bond Fund, Fund 6303, to align cash and appropriation with the proper project; and

 

WHEREAS, it is necessary to authorize an expenditure of funds from the Electricity Bond Fund, Fund 6303, to pay for the contracted services for the project; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities in that it is immediately necessary to authorize the Director to enter into a contract for professional engineering services with Patrick Engineering, Inc., for the Comprehensive Master Planning Consulting for Division of Power project to allow the Division of Power to quickly address evolving challenges in the electric utility industry to continue to provide affordable and reliable power to residents, all for the immediate preservation of the public health, peace, property, safety, and welfare; and NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the 2024 Capital Improvements Budget authorized by Ordinance 1907-2024 be amended as follows to establish sufficient budget authority for this project:

SECTION 2.  That the transfer of $205,786.15, or so much thereof as may be needed, is hereby authorized in Fund 6303 (Electricity Bond Fund) per the accounting codes in the attachment to this ordinance.

 

SECTION 3.  That the Director of Public Utilities is hereby authorized to enter into a professional services and construction services contract for the Comprehensive Master Planning Consulting Services for the Division of Power project with Patrick Engineering, Inc, 100 E. Campus View Blvd., Suite 300, Columbus, OH 43235, in an amount up to $205,786.15, in accordance with the terms and conditions of the contract on file in the Department of Public Utilities.

 

SECTION 4.  That the expenditure of $205,786.15, or so much thereof as may be needed, is hereby authorized to pay for this contract per the accounting codes in the attachment to this ordinance.

 

SECTION 5.  Funds are hereby deemed appropriated and expenditures and transfers authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 7.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 8.  That for the reasons stated in the preamble hereto, which is made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten (10) days after passage if the Mayor neither approves nor vetoes the same.
