Explanation
BACKGROUND:
This ordinance will authorize the Director of the Department of Technology to modify an existing contract with Oarnet/OSU, a local non-profit educational institute (servicing grades K-12, colleges and universities), to increase the fiber network and broadband access and related services to enhance the speed of the City's internet access and to renew/extend the contract for an additional one year term.  The original contract was authorized by ordinance 0789-2007 (purchase order EL007115), passed June 4, 2007.  The contract was most recently renewed by authority of ordinance 0487-2011 (purchase order EL011948), passed June 13, 2011.  The modification to increase the current 50Mbps (megabyte per second) fiber and broadband service to 100Mbps service will be effective starting June 01, 2012 and pro-rated for two months to keep the service term co-terminus with existing contract term at the additional cost of $2,483.86.   The Department of Technology requests that the passage of this ordinance will also allow for the extension of existing purchase order (EL011948), Auditor Certificate (No. AC032456 ), and the associated funds through July 24, 2013. The contract renewal/extension for the term period from July 25, 2012 through July 24, 2013 will cost $37,200 for the 100 Mbps service level.
 
This modification increases the funding for this service by $16,800 annually from $20,400 to $37,200 per year.  This modification is necessary to accommodate the growing volume of data being transferred over the City's internet connections, which increasingly consists of high volume video traffic.  This traffic has grown beyond expectations when the contract was last renewed, so this is an unforeseen modification.  As a non-profit organization, OSU/Oarnet has made significant investments in fiber and broadband access.  It is in the City's best interests to leverage those investments by partnering with Oarnet/OSU by utilizing existing fiber connectivity and resources, instead of obtaining this service through alternative procurement processes.  The cost for this service was negotiated with Oarnet/OSU, and reflects standard public sector pricing.
As described above, it is in the City's best interests to leverage existing OSU/Oarnet investments.  So this ordinance requests approval to enhance services provided by Oarnet/OSU and to waive the competitive bidding provisions of Columbus City Codes (329.06).
EMERGENCY:  
Emergency action is requested to expedite authorization of this contract in order to initiate services from the supplier at the prices proposed.
FISCAL IMPACT:
During fiscal years 2010 and 2011 funds in the amount of $31,200.00 and $31,200.00 were legislated respectively for fiber network, broadband access related services.  With the  passage of this ordinance to provide for the extension of existing purchase order (EL011948), Auditor Certificate (No. AC032456), and the associated funds through July 24, 2013, the amount of $37,200.00, is budgeted and available within the Department of Technology Information Services Division, Internal Services Fund. The aggregate contract total, including this request is $303,403.86.

WHEREAS, this ordinance will authorize the Director of the Department of Technology on behalf of the City of Columbus to modify an existing contract with The Ohio State University/Ohio Supercomputer Center (OSC); a local non-profit educational institute (servicing grades K-12, colleges and universities) and provider of the State of Ohio's OSCnet (OARnet), to increase the fiber network and broadband access and related services to enhance the speed of the City's internet access from 50Mbps (megabyte per second) service to 100Mbps service effective June 01, 2012,  and pro-rated for two months to keep the service term co-terminus with existing contract term at the additional cost of $2,483.86, and
WHEREAS, this contract renewal/extension allows The Ohio State University/Ohio Supercomputer Center and the Department of Technology,, to work together to connect OSCnet's (OARnet) statewide network to the city's community fiber network; cables laid to provide connections for information transmission throughout communities, and provide for annual fiber network, broadband access and related services, with a term period from July 25, 2012 through July 24, 2013 at a cost of $37,200.00, and
 
WHEREAS, this ordinance also requests to extend an existing purchase order (EL011948), Auditor Certificate (No. AC032456) and the associated funds for an additional year through July 24, 2013, and
WHEREAS, this ordinance requests approval to continue services provided by OSU/OSC, and to waive the competitive bidding provisions of Columbus City Code, Section 329.06; as it has been determined that OSU/OSC will enter into a contract with the Department of Technology, and
WHEREAS, an emergency exists in the usual daily operation of the city in that it is immediately necessary for the Director of the Department of Technology to modify and renew/extend an existing contract with The Ohio State University/Ohio Supercomputer Center, on behalf of the City of Columbus, for fiber network and broadband access and related services, for the  preservation of the public health, peace, property, safety and welfare; now, therefore:        
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1: That the Director of the Department of Technology be and is hereby authorized to modify and renew/extend an existing contract with The Ohio State University/Ohio Supercomputer Center (OARnet) for an increase in fiber network, broadband access and related services to enhance the speed of the City's internet access from 50Mbps (megabyte per second) service to 100Mbps service effective June 01, 2012, pro-rated for two months to keep the service term co-terminous with existing contract term at the additional cost of $2,483.86 and an additional one year term through July 24, 2013 in the amount of $37,200.00 for a total of $39,683.86.  This ordinance also authorizes the extension of an existing purchase order (EL011948), Auditor Certificate (No. AC032456) and the associated funds for an additional year through July 24, 2013.  
 
 
SECTION 2: That the expenditure of $37,200.00 or so much thereof as may be necessary is hereby authorized to be expended from:

SECTION 3: That the City Auditor is authorized to make any changes to revise the funding source for any contract or contract modifications associated with this ordinance.
SECTION 4: That this ordinance authorizes a contract between OSU/OSC and the Department of Technology, on behalf of the City of Columbus, and to waive the competitive bidding provisions of Columbus City Code, Section 329.06.
SECTION 5: That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure, and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
