BACKGROUND:  This legislation authorizes the transfer of monies within the Storm Sewer Bonds Fund; authorizes the transfer, appropriation and expenditure of monies from the Storm Sewer Reserve Fund to the Storm Sewer Bond Fund; and amends the 2003 Capital Improvements Budget so as to allow sufficient funds and authority to acquire the necessary easements, professional services and administrative costs for the following Capital Improvements Projects:

610840:  Oaklawn/Piedmont - $5,000.00
610988:  Francisco Road - $100,000.00
610996:  Briarmeadow Drive Culvert - $10,700.00
610712:  Refugee Road Pump Station - $37,500.00
610994:  McDannald Estates - $54,725.00
610946:  Trentwood/Shadyhill - $70,350.00
610923:  Bliss Run Phase 3 - $50,000.00
610037:  East Central Relief - $17,000.00
610714:  Mock Road Storm - $25,000.00
 
EMERGENCY DESIGNATION:  This ordinance is submitted as a emergency so as to allow the easements to be acquired as soon as possible to maintain project construction schedules.  
 
FISCAL IMPACT:  The projects for which this legislation requests fund transfer currently have insufficient balances to allow for the aforementioned expenditures.  These transfers do not reflect any changes to the projects planned in the 2003 Capital Improvements Budget (CIB).  The changes are a temporary measure for the project that is being designed or constructed to maintain efficient cash flow within Stormwater CIB Funds will be made available for all approved projects as needed.
 
This fund transfer from the Storm Sewer System Reserve Fund to the Storm Sewer Bond Fund is a temporary measure, until such time as the proceeds from a bond sale can be made available.
 
 
 
Title
 
To authorize the City Auditor to make an intra-subfund transfer of $113,668.22 within the Storm Sewer Bonds Fund; to authorize the City Auditor to transfer, and appropriate $270,186.78 from the Storm Sewer System Reserve Fund to the Storm Sewer Bond Fund; for the Division of Sewerage and Drainage to provide the necessary capital projects funds for land acquisition services; to amend the Capital Improvements Budget to accommodate these various transactions; and to declare an emergency. Body
 
WHEREAS, it is required in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, to maintain, upgrade and expand its storm sewer collection system; and
 
WHEREAS, it is necessary to transfer funds within the Storm Sewer Bonds Fund for land acquisition services for various projects; and
 
WHEREAS, it is necessary to transfer funds from the Storm Sewer System Reserve Fund to the Storm Sewer Bonds Fund for the aforementioned costs; and
 
WHEREAS, this transfer does not adversely affect any project in the 2003 Capital Improvements Budget; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, in that it is immediately necessary to authorize the City Auditor to transfer funds within the Storm Sewer Bonds Fund; to transfer funds from the Storm Sewer System Reserve Fund to the Storm Sewer Bonds Fund; and to amend the 2003 Capital Improvements Budget to execute the aforementioned capital project related transactions, so as to allow the easements to be acquired as soon as possible to maintain project construction schedules, all for the preservation of the public health, peace, property and safety; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the City Auditor is hereby authorized and directed to transfer monies within the Storm Sewer Bonds Fund, Fund 685, Division of Sewerage and Drainage, Division 60-15, as follows:

452501:  Geographic Information System - $2,537.42
610723:  East Street Sewer Replacement - $35,000.00
610998:  Neighborhood Project-Memory Lane - $76,130.80
 
TRANSFER TO:
610736:  685736:  Glendower/Llewellyn - $13,580.00
610840:  685840:  Oaklawn/Piedmont - $88.22
610988:  685988:  Francisco Road - $100,000.00
 
Section 2.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
 
Section 3.  That from the unappropriated monies in the Storm Sewer System Reserve Fund, and from all monies estimated to come into said fund from any and all sources, and unappropriated for any other purpose during the fiscal year ending December 31, 2004, the sum of $270,186.78, is hereby appropriated to the Division of Sewerage and Drainage, Division 60-15| Object Level 10| Object Level Three 5502| OCA Code 901685.
 
Section 4.  That the City Auditor is hereby authorized and directed to transfer $270,186.78, from the Storm Sewer System Reserve Fund to the Storm Sewer Bond Fund No. 685, Object Level Three 6621 as follows:

Section 5.  That upon obtaining other funds for the purpose of funding the aforementioned stormwater system improvements project work, the City Auditor is hereby authorized to repay the Storm Sewer System Reserve Fund the amount transferred under Section 2., above, and said funds are hereby deemed appropriated for such purpose.
 
Section 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for any contract associate the expenditure of the funds transferred under Section 2., above.
 
Section 7.  That the 2003 Capital Improvements Budget is hereby amended as follows, in order to establish sufficient funding authority:
