Explanation
 
Background:  Ordinance 1392-2002 authorized the purchase of the Clerk's HP9000 database server and three years of hardware and software support.  The HP9000 is a high-end platform mainframe server for the Franklin County Municipal Court case management system.  The software support services aspect of the contract expired on November 7, 2005.  Ordinance 2171-2005 authorized the purchase of an additional three months of support services with the agreement expiring on January 31, 2006.
 
The Franklin County Municipal Court Clerk is seeking approval to extend the current support agreement with OmniTec, Inc. for four additional months, from February 1, 2006 through May 31, 2006.  Continuation of hardware and software support is essential for the Municipal Court's critical business applications, its court case management system.  The additional time will enable the Clerk to identify alternative and more cost effective sources for the support both from potential vendors, including city's Department of Technology.  Since there is insufficient time to identify other sources of the software and hardware support, it is in the best interest of the city to waive the provisions of competitive bidding and enter into and agreement with OmniTec, Inc.  
 
 
Emergency:  This ordinance is being submitted as an emergency measure to provide for uninterrupted support services for the Franklin County Municipal Court Clerk.
 
Fiscal Impact:  The total cost for four months of support is $36,925.20 and is budgeted and available within the Franklin County Municipal Court Clerk's 2006 computer fund budget.

Whereas, ordinance 1392-2002 authorized the purchase in 2002 of a new database server , the HP9000, with three years of support services from OmniTec, Inc.; and
 
Whereas, the agreement for support expired on November 7, 2005; and
 
Whereas, ordinance 2171-2005 authorized the purchase of a 3 month support agreement with OmniTec, Inc. for the HP9000 database server support services that expires January 31, 2006; and
 
Whereas, continuation of the support agreement with OmniTec, Inc. for four additional months is needed to permit the Clerk sufficient time to research an alternative for more cost effective sources for support; and
 
Whereas, due to the circumstances described herein, it is necessary to waive the provisions of competitive bidding for this agreement; and
 
Whereas, an emergency exists in the usual daily operation of the Municipal Court Clerk's Office in that it is immediately necessary to provide for ongoing and uninterrrupted support for the HP9000 database server, thereby preserving the public health, peace, property, safety, and welfare; now therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1. That the Franklin County Municipal Court Clerk be and hereby authorized to enter into an agreement with OmniTec, Inc., for hardware and software support from February 1, 2006 through May 31, 2006.
 
Section 2. That in accordance with Section 329.27 of the Columbus City Code, this Council finds the best interest of the City is served by waiving and does hereby waive section 329.06 (Formal Competitive Bidding) of the Columbus City Code.
 
Section 3.  That for paying the cost thereof, the sum of $36,925.20 or so much thereof as may be needed is hereby authorized to be expended from the Municipal Court Clerk's special revenue fund, organization 2601, fund 227, subfund 002, oca code 260208, object level one 03, object level 3369.
 
Section 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measurer and shall take in effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
