Explanation
Background: The City of Columbus, Recreation and Parks Department desires to purchase certain real property located within the Island View Subdivision, along the Olentangy River. Rocky and Jerri Spears, the owners, desire to sell the subject property to the City. The property shall be acquired for the purpose of expanding parklands on the eastern bank of the Olentangy River between Kenney Park and Antrim Park. The following legislation authorizes the Director of the Recreation and Parks Department to execute those documents necessary enter into a contract by and between the City of Columbus, Ohio and Rocky and Jerri Spears, to purchase the aforementioned real property, and to expend $5,028.00 for cost relevant to its acquisition.
Fiscal Impact: The Recreation and Parks Department has determined that $5,028.00 of the purchase price will come from the Recreation and Parks Voted 1999/2004 Bond Fund.
Emergency Justification: Emergency action is requested to allow this acquisition to proceed in agreement with the closing transaction deadline and other terms and conditions of the purchase contract.

WHEREAS, the City of Columbus, Recreation and Parks Department desires to purchase certain real property in the Island View Subdivision, along the Olentangy River; and
WHEREAS, Rocky and Jerri Spears, the owners, desire to sell the subject property to the City of Columbus; and
WHEREAS, the property shall be acquired for the purpose of expanding parklands on the eastern bank of the Olentangy River between Kenney Park and Antrim Park; and
WHEREAS, it is necessary to expend $5,028.00 from the Recreation and Parks Voted 1999/2004 Bond Fund for cost relevant the acquisition of the subject property; and
WHEREAS, an emergency exists in the usual daily operation of the City of Columbus, in that it is immediately necessary to authorized the Director of the Recreation and Parks Department to execute those documents necessary for the purchase said real property for the immediate preservation of the public health, peace, property and safety; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of the Recreation and Parks Department be, and hereby is, authorized to execute those documents necessary for the purchase of the following described real property:
Situated in the Township of Sharon, County of Franklin, and State of Ohio. Being Lot No. 7 in Island View Addition, a Subdivision of Lots 65, 66, 67, 68 of Henry C. Lowrie's Homedale Acre Allotment, Plat Book 10 Pages 146 and 147, as the same are number and delineated upon the recorded plat thereof, of record in Plat Book 18 , Page 26, Recorder's Office, Franklin County, Ohio. Franklin County Tax Parcel No. 254-151792
Section 2. That the expenditure of $5,028.00, or so much thereof as may be necessary from the Recreation and Parks Voted 1999/2004 Bond Fund, Fund #702, Dept.Div. 51-01; Project No. 510112 (Parkland Acquisition); OCA Code 644526; Object Level Three 6601 for the aforesaid purpose is hereby authorized.
Section 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
