Explanation
Initial funding for acquisition related activities for the Riverview Drive Improvement project, in the amount of $123,000.00, was established pursuant to Ordinance 0385-2005 (AC024225) and additional funding, in the amount of $45,000.00, was authorized pursuant to Ordinance 0688-2006 (AC025724). At this time the City of Columbus is completing the acquisition of right-of-way for this project and these funds have been spent. The City Attorney's Office, Real Estate Division, filed a complaint in Franklin County, Ohio, Common Pleas Court (Court Case 06CVH-11-14561) for the acquisition of Parcel 19 WD, T and placed $11,793.00 (the appraised value of the WD and T parcels) on deposit with the Court. The City Attorney's Office and the property owner have reached an agreement regarding the City's purchase of these rights-of-way. Additional funding, in the amount of $10,000.00, is now needed to pay settlement, court and miscellaneous other acquisition costs for Parcel 19.
Fiscal Impact: The following legislation authorizes the City Attorney to expend $10,000.00, or so much thereof as may be necessary, to pay for settlement, court and miscellaneous other acquisition related costs for Parcel 19 of the Riverview Drive Improvement project. Monies to pay for these costs are available in the Streets and Highway Improvement Fund.
Emergency action is requested so the settlement fees can be deposited with the Court and acquisition of the additional rights-of-way needed for this project can be completed without delay.

WHEREAS, initial funding for acquisition related activities for the Riverview Drive Improvement project, in the amount of $123,000.00, was established pursuant to Ordinance 0385-2005 (AC024225); and
WHEREAS, additional funding, in the amount of $45,000.00, was authorized pursuant to Ordinance 0688-2006 (AC025724); and
WHEREAS, at this time the City of Columbus is completing the acquisition of right-of-way for this project and these funds have been spent; and
WHEREAS, the City Attorney's Office, Real Estate Division, filed a complaint in Franklin County, Ohio, Common Pleas Court (Court Case 06CVH-11-14561) for the acquisition of Parcel 19 WD, T and placed the appraised value of these rights-of-way ($11,793.00) on deposit with the Court; and
WHEREAS, the City Attorney's Office, Real Estate Division, and the owner of Parcel 19 have reached an agreement regarding the City's purchase of the necessary rights-of-way; and
WHEREAS, additional funding, in the amount of $10,000.00, is now needed to pay settlement, court and miscellaneous other acquisition costs for Parcel 19; and
WHEREAS, the following legislation authorizes the City Attorney to expend $10,000.00, or so much thereof as may be needed to pay these settlement, court and miscellaneous other acquisition related costs; and
WHEREAS, funds are available in the Streets and Highway Improvement Fund to pay for said costs; and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that it is immediately necessary to authorize the City Attorney to expend the funds necessary to pay these settlement, court and miscellaneous other acquisition related costs for Parcel 19 without delay for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the City Attorney be and is hereby authorized to expend those funds necessary to pay settlement, court and miscellaneous other costs needed to complete the right-of-way acquisition of Parcel 19 on the Riverview Drive Improvement project.
SECTION 2. That for the purpose of paying for said costs the City Attorney's Office, Real Estate Division, is hereby authorized to expend an additional $10,000.00, or so much thereof as may be necessary from the Streets and Highway Improvement Fund, Fund 766, Department/Division 59-09, as follows:

SECTION 3. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
