Explanation
BACKGROUND: This legislation authorizes the Finance and Management Director to modify and extend an existing Universal Term Contract (UTC) for the option to obtain HIV Testing Supplies with Abbott Laboratories Inc. CC# 023644, (Pending). This contract provides for HIV Testing Supplies used by the Columbus Public Health Department to perform rapid HIV tests. This modification is necessary as Abbott Laboratories is the sole manufacturer of these products and the products are needed for an additional period of time. The Columbus Health Department is making changes in their laboratory and has chosen not to negotiate a new contract but requests that the contract be modified and extended to allow the testing supplies to be purchased for an additional one (1) year period, as the items used will no longer be used in the laboratory after 2026. The contract, PO304971, is a sole source negotiated contract and will expire on January 31, 2026.
Pursuant to Section 329.09(a) of Columbus City Codes:
(1) Amount of additional funds to be expended under the modification: No additional funding is necessary to modify the option contract.
(2) Why the need for additional goods or services could not be foreseen at the time the contract was initially awarded: N/A
(3) Why it would not be in the city's best interests to have the additional contract requirements awarded through other procurement processes specified in this chapter: Abbott Laboratories is the sole manufacturer of these products as they are the only distributor and authorized provider. Columbus Public Health has confirmed that these supplies will only be needed for 2026, and not beyond.
(4) How the price for the additional goods or services which are the subject of the modification was determined: N/A
EMERGENCY DESIGNATION: The Finance and Management Department respectfully requests this legislation be considered an emergency because the current contract expires on January 31, 2026 and this lab based test and supplies contract is needed to allow the Columbus Public Health Department to continue to provide rapid same day results as well support the CDC guidelines recommended for 4th generation HIV testing.
FISCAL IMPACT: No funding is required to modify the option contract. The Columbus Public Health Department must set aside its own funding for estimated expenditures.

WHEREAS, the Purchasing Office entered into a Universal Term Contract for HIV Testing Supplies used by the Columbus Public Health Department; and
WHEREAS, it is necessary to modify and extend the existing Universal Term Contract with Abbott Laboratories Inc. to ensure testing supplies are available to perform HIV rapid tests for same day results; and
WHEREAS, an emergency exists in the usual daily operation of the Columbus Public Health Department in that it is necessary to authorize the Finance and Management Director to immediately modify a Universal Term Contract with Abbott Laboratories Inc. for the option to obtain HIV Testing Supplies used by the Columbus Public Health Department to perform rapid HIV tests as the current contract expires on January 31, 2026 and this modification is necessary as Abbott Laboratories is the sole manufacturer of these products, and the Columbus Health Department is making changes in its laboratory and has chosen not to negotiate a new contract, but requested that the existing contract be modified and extended to allow the testing supplies to be purchased for an additional one (1) year period, as the items used will no longer be used in the laboratory after 2026, all for the immediate preservation of the public health, peace, property, safety, and welfare; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Finance and Management Director is hereby authorized to modify and extend the contract for the option to obtain HIV Testing Supplies with Abbott Laboratories Inc. for a one-year period, or portion thereof, to and including January 31, 2027.
SECTION 2. That this modification is in accordance with relevant provisions of Chapter 329 of the Columbus City Codes.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
