APPLICANT: Front Street Brewing II, LLC; c/o David Hodge, Atty.; Smith & Hale, LLC; 37 West Broad Street, Suite 725, Columbus, OH 43215.
 
PROPOSED USE: Multi-family Dwelling Units.
 
BREWERY DISTRICT COMMISSION RECOMMENDATION:  Approval.                                                       
 
CITY DEPARTMENTS' RECOMMENDATION: Approval.  The applicant is applying for a Council variance to redevelop an existing structure with sixty-two  multi-family dwelling units without on site parking.  The applicants have a written agreement to provide sixty-one parking spaces for the residents at a nearby parking garage.  The site is located within the boundaries of The Brewery District Plan (1993).

To grant a Variance from the provisions of Sections 3363.01, M-Manufacturing district; 3342.28, Minimum number of parking spaces required, and 3363.24, Building lines, of the Columbus City Codes for property located at 570 SOUTH FRONT STREET (43215), to permit 62 dwelling units with reduced development standards in the M, Manufacturing District.    
 
 
Body
 
WHEREAS, by application No. CV07-038, the owner of property at 570 SOUTH FRONT STREET (43215), is requesting a Council variance to permit multi-family dwellings in the M, Manufacturing District; and
 
WHEREAS, Section 3363.01, M-Manufacturing districts, prohibits multi-family residential development, while the applicant proposes a total of 62 multi-family dwelling units; and
 
WHEREAS, Section 3342.28, Minimum Number of Parking Spaces Required, requires two off-street parking spaces per dwelling unit for a total of 124 parking spaces, while applicant proposes to provide 61 off-site parking spaces as approved by the Division of Transportation; and
 
WHEREAS,  Section 3363.24, Building lines in an M-Manufacturing District, provides for minimum building lines along public streets, while the applicant proposes to eliminate the building lines along all applicable public rights-of-way; and  
   
WHEREAS, said ordinance requires separate submission for all applicable permits and Certificate of Occupancy for the proposed use; and
 
WHEREAS, the Brewery District Commission recommends approval; and
 
WHEREAS, the City Departments recommend approval; and
 
WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent property, unreasonably increase the congestion of public streets, increase the danger of fires, endanger the public safety, unreasonably diminish or impair established property values within the surrounding area, or in any other respect impair the public health, safety, comfort, morals, or welfare of the inhabitants of the city; and
  
WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at 570 SOUTH FRONT STREET (43215), in using said property as desired; now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

The land referred to herein is situated in the State of Ohio, County of Franklin, City of Columbus and described as follows:
 
Being 93 feet fronting on Park Street by 187 ½ feed depth, being Lot No. 670 and the North one half of Lot No. 671, in McGown's Addition to the City of Columbus, as the same are numbered and delineated upon the recorded plat thereof, of record in Deed Book "G", Page 70, Recorder's Office, Franklin County, Ohio, and being the same premises conveyed to the Hercules Building Company by the Franklin Die Tool Company, by deed dated January 18, 1922, and recorded in Volume 707, page 335, of the Deed Records of said County.
 
Section 1.  That a variance from the provisions of Sections 3363.01, M-Manufacturing districts; 3342.28, Minimum number of parking spaces required; and 3363.24, Building lines, of the Columbus City Codes for property located at 570 SOUTH FRONT STREET (43215), insofar as said sections prohibit 62 dwelling units with the following reduced development standards: with off-street parking spaces reduced from 124 to 0; and with building setbacks reduced to zero (0) feet along public streets; said property being more particularly described as follows:
 
Section 2.  That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for 62 dwelling units or those uses permitted in the M-Manufacturing District.
 
Section 3.  That this ordinance is conditioned on at least one bicycle rack being provided on site.
 
Section 4.  That this ordinance is further conditioned on the Subject Site being developed in general conformance with the site plan titled, "SALVATION ARMY BUILDING CONVERSION," drawn by EMH&T, dated August 31, 2008, and signed by David Hodge, attorney for the applicant.  The Site Plan may be slightly adjusted to reflect engineering, topographical, or other site data developed at the time of the development and when engineering and architectural drawings are completed.  Any slight adjustments to the Zoning Site Plan shall be subject to review and approval by the Director of the Department of Development, or his designee, upon submission of the appropriate data regarding the proposed adjustment.
 
Section 5. That this ordinance is conditioned on the applicant or owner filing an application to rezone this property to either an Apartment Residential District or  Limited Apartment Residential District along with a concurrent Council variance and having these applications on the Agenda of the Columbus City Council for consideration by no later than January 31, 2010.
 
Section 6.  That this ordinance is further conditioned on the applicant obtaining all applicable permits and a Certificate of Occupancy for the proposed use.
 
Section 7.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
