Explanation
 
BACKGROUND:  This ordinance amends the 2006 Capital Improvement Budget and authorizes the transfer of $1,377,830.06 from the Fire Station 35 (Waggoner Road) Project to the Fire Station 10 (West Broad Street) Project for the construction of Fire Station 10.  This ordinance also authorizes the Finance and Management Director to enter into contract for the Office of Construction Management with Gutknecht Construction Company, Inc., for the construction of Fire Station 10 at 1080 West Broad Street.  This project will be a LEED (Leadership in Energy and Environmental Design) Certified building, in compliance with the Mayor's Get Green Columbus initiative.  LEED is administered by the United States Green Building Council, and is the nationally accepted benchmark for the design, construction, and operation of high performance green buildings.  LEED components in this project will include highly efficient lighting, triple paned windows, energy efficient HVAC systems, and the use of recycled buildings materials.  LEED also encourages community projects, and this will be accomplished by an exterior memorial for FF Maurice Gates of Ladder 10, who was killed in the line of duty on September 15, 1982.  In tandem with this new era technology, the new fire station is also designed to meet the old era architectural aesthetics of the community, blending in with old Fire Station 10, built in 1896.
 
Formal bids were solicited on February 6, 2007 and five companies submitted bids on March 19, 2007 as follows (1 MBE*, 0 FBE):

The Office of Construction Management recommends the bid award be made to the most responsive and responsible and best bidder, Gutknecht Construction Company, Inc.  The three lowest bidders were within 2.39% of each other, after the creditable factors found in Columbus City Codes 329.09 were applied.  Using the evaluation criteria as promulgated in Columbus City Codes 329.09, the project engineer, the Equal Business Opportunity Commission Office, and the Office of Construction Management all ranked Gutknecht Construction Company as the best bidder.  The most notable criteria in Gutknecht's favor were its superior performance on past fire stations and LEED buildings.  
 
EMERGENCY ACTION is requested to ensure the construction of the new fire station begins as soon as possible.
 
Gutknecht Construction Company, Inc.  Contract Compliance Number 31-0935568, expiration date 09-24-2007.
 
FISCAL IMPACT:  The original budgeted amount in the Safety Capital Budget for Fire Station 10 construction was $3.13 million.  A surplus of $77,830 from the Fire Station 35 Project is to be transferred to this project.  An additional $1.3 million is needed for a total construction budget of $4.5 million.  The additional $1,377,830 will be transferred from the Fire Station 35 Project with $1,300,000 of the amount being reimbursed to the project.  The total cost is $4,454,208.00.
 
The Department of Public Safety has determined that the expenditure for this purchase will come from existing Voted 2004 Safety Bond Funds.  Currently, the Fire Station #35 (Waggoner Road) project has an unencumbered cash balance of $2,283,316.  This proposed transfer of $1,377,830 will pay for the for expenses associated with the construction of Fire Station 10.  The 2007 Capital Improvement Budget, when presented to City Council for passage, will include $1,300,000 of budget authority for the Fire Station #35 project.  This authority will allow for the reimbursement of $1,300,000 for this project when the city conducts the 2007 bond sale later in the year.  If monies are needed before this bond sale occurs, the administration will request the City Auditor's office to certify against the Special Income Tax fund.  This will allow the project to proceed without any delays in the construction schedule.

WHEREAS, it is necessary to amend the Safety Voted Bond Fund and to transfer funds in order to construct a new Fire Station 10, and
 
WHEREAS, formal bids were solicited for the construction of said new fire station, and
 
WHEREAS, the Office of Construction Management recommends Gutknecht Construction Company, Inc. as the most responsive and responsible bidder and best bidder, and
 
WHEREAS, an emergency exists in the usual daily operation of the Finance and Management Department, Office of Construction Management, in that it is immediately necessary to authorize the Finance and Management Director to enter into contract with Gutknecht Construction Company Inc., for the construction of Fire Station 10, thereby preserving the public health, peace, property, safety, and welfare; now, therefore:

SECTION 1.  That the 2006 Public Safety Capital Improvement Budget is hereby amended as follows:
